SUBJECT:

STAFF REQUIREMENTS - BRIEFING ON STAFF ACTIONS REGARDING MILL TAILINGS REGULATIONS The Comission was briefed by the staff on the status of and projected schedule for actions on the uranium mill tailings regulations on January 28, 1983. As a result of that briefing, the Commission requested that the staff:

1.

Provide a schedule of milestones on the working group's activities.

2.

Submit staff coments on' the Environmental Protection Agency's (EPA) proposed Title II standards (when issued) for Commission approval, after coordinating with,the Office of the General Counsel.

The most critical action that must be accomplished in the near future is the suspension of selected portions of 10 CFR Part 40, Appendix A, fol-

  • lowing the publication of EPA's proposed Title 11 standards. The staff has prepared a schedule for accomplishing this suspension within the 90-day time period mandated by the Authorization Act.

Staff actions will be triggered by publication by EPA of the proposed Title II standards.

The. schedule is extremely tight and will require close coordination and short review times if it is to be met.

A preliminary draft of a Federal Register notice to suspend portions of the present regulations is being prepared based on anticipated provisions of' EPA's proposed Title II standards.

Completion of this initial phase of the suspension action will proceed upon publication by EPA of _ proposed Title II standards.

Attached is a schedule of the major milestones for revising the NRC mill tailings regulations to conform with EPA Title 11 standards. The NRC schedule is dependent on the date that EPA publishes its proposed Title II standa'rds. Should EPA fail to meet its current schedule the NRC schedule will be adjusted accordingly. The Commission will be informed of any changes necessary.

The current NRC schedule is based on the most recent EPA. schedule 'that was

'provided by EPA staff on February 25, 1983. The NRC staff schedule also is based on the assumption that EPA will meet the September 30, 1983 date mandated by the Authorization Act for publication of its final standards.

If EPA fails to oublish.the final Title II standards by Sdptember 30, 1983, the Authorization Act provides that the authority of EPA to promul-gate such standards'shall terminate and the Commission may take actions which it deems necessary to carry out its responsibility in the conduct of licensing activitici, including the promulgation of standards of general

application.

You will note that the date on the attached schedule for providing staff comments to the Commission is now April 27, 1983 rather than the SECY cate of March 31, 1983.

This change is necessitated by the delay of EPA in publishing the proposed Title II standards.
