Gentlemen:

Thank you for your letter of April 29. J985, and July 23, 1985, in response to

our telephene conversation of April 26, 1985, and to our letter and Notice of

Violation dated June 24, 1985. We have reviened your reply and find it

responsive to the concerns raised in our Notice of Violation, with an

exception. Our inspections are conducted against the commitments that you ,

made to meet the requirements of 10 CFR 73.55 as embodied in your approved

physical security plan. You pointed out that some of the methodology that

AP!.L selected, and which was approved by NRC to bring ANO into compliance, was

not specified in the regulation. While that is true, it does not exonerate

you from violation when that methodology fails. The enforcement policy of the

NRC dictates that security violations be written against the plans and the

procMures written to implement the plans. Alarm assessment capability is a

specific exaaple. During a future inspection we will review the implementation

of your corrective actions. This will be done to determire that full compliance

has been achieved and will be maintained. That action is understood to include

the utilization of appropriate compensatory measures during periods awciting

corrective action.

Your letter ray contain safeguards information, while not so labeled, of a

type specified in 10 CFR 73.21 and is temporarily being withheld from public

disclosure awaiting your review. Please notify us of your decision.
