SECY-87-120 - PROPOSED TECHNOLOGY TRANSFERS TO THE PEOPLE'S '

REPUBLIC 0FCHINA(PRC)

This is in response to the Comission's request in Mr. Chilk's memo of June 2 to clarify the status of the US/PRC Agreement for Cooperation as stated in GPA's paper SECY-87-120.

While DOE is technically correct in stating that the US/PRC Agreement entered into force on December 30, 1985, certain necessary implementing arrangements have not yet been completed; and, accordingly, no bilateral cooperation activities can take place under the Agreement. The Executive Branch must also go back to Congress before the Agreement can be implemented. This is required by Senate Joint Resolution 238 (signed by the President on December 16, 1935) which states that no exports to the PRC under the Agreement can take place until the President certifies to Congress (1) that reciprocal arrangements on visits and exchanges of infonnation have been made to ensure the U.S. that any nuclear material, facilities, or components exported under the Agreement will be used for solely peaceful purposes, and (2) that the Government of the PRC has ,

provided additional infonnation concerning its nuclear nonproliferation policies to ensure the U.S. that the PRC is not in violation of Section 129 of the Atomic Energy Act of 1954.

The State Department advises that further discussionswith PRC officials on the implementing arrangements are currently taking place. We will keep the Comission infonned of any significant developments.
