Thank you for your response of April 4,1985, to our Notice of Violation issued

j

on March 5, 1985, concerning activities conducted at your Crystal River facility.

The above Notice of Violation cited your failure to have approved written radia-

j

tion protection procedures for the calibration of the whole-body counting system

!

presently in use. Your response stated that the bioassay program is not included

i

in Appendix A of Regulatory Guide 1.33, November 1972 and therefore Florida Power

i

Corporation was not in violation of Technical

Specification procedural

j

requirements.

j

i

We disagree with your interpretation of Regulatory Guide 1.33, Appendix A issued

!

November 1972. Section G.5.c of the referenced guide states that the control of

!

j

radioactivity in regard to personnel exposure which includes surveys and

!

mcnitoring should be covered with written procedures.

We believe that your

j

whole-body counter was included in your personnel monitoring program, and as

,

j

such, calibrations must be conducted in accordance with approved procedures.

After careful consideration of your denial of the noted Violation, we have

,

I

concluded, for the reasons presented in this letter, that the violation occurred

j

as stated in the Notice of Violation.

Therefore, in accordance with

j

10 CFR 2.201(a), please submit to this office within 30 days of the date of this

~

j

letter a written statement describing corrective steps which will be taken to

j

avoid similar violations and the date when full compliance will be achieved.

l

The response directed by this letter is not subject to the clearance procedures

i

)

of the Office of Management and Budget issued under the Paperwork Reduction Act

I

of 1980, PL-511.
