ROUTINE RESIDENT INSPECTION AT DAVIS-BESSE (50-346/96006):

NOTICE OF VIOLATION

Dear Mr. Wood:

On October 9,1996, the NRC completed an inspection at your Davis-Besse site.

The enclosed report presents the results of that inspection.

Activities conducted at the plant were observed to be predominantly Jerformed

in a controlled manner and in accordance with approved procedures.

.three issues' associated with test control were identified by NRC inspectors

that indicated a less than rigorous implementation of surveillance activities

and are considered, in the aggregate, a violation of NRC requirements.

Specifically:

1) a test deficiency was improperly documented and . initially

dispositioned, 2) inadequate adherence to test procedure requirements resulted-

.

in improper stroke timing of a' containment spray valve, and 3) inadequate

control of soluble plastic used on floor drains in the auxiliary building

i

negative pressure boundary potentially invalidated one or more emergency.

'

ventilation system drawdown tests.

The violation is cited in the enclosed Notice of Violation, and the

circumstances surrounding the violation are described in detail in the

enclosed report.

Please note that you are required to respond-to this letter

'

and should follow the instructions specified in the enclosed Notice when

preparing ~your response. The NRC will use your response, in part, to

determine whether further enforcement action is necessary to ensure compliance

with regulatory requirements.

In addition, a followup of a plant employee's failure to properly complete

required surveillance testing of emergency battery lights was conducted during

this inspection. The NRC Office of Investigations (01) had previously

reviewed this matter and determined that the employee had violated 10 CFR 50.5

due to. deliberate misconduct on his part. As such, a Notice of Violation was

issued to the individual (who has since resigned) under separate cover.

Because the problem was originally identified by your staff, and appropriate

followup actions were taken by Davis-Besse, this matter was considered a non-

cited violation against the facility.
