NRC RADIATION PROTECTION INSPECTION REPORTS NO. 50-266/

96016(DRS) AND 50-301/96016(DRS); NRC OFFICE OF INVESTIGATION

REPORT NO. 3-95-043 AND NOTICE OF VIOLATION

Dear Mr. Patuiski:

09 December 6,1996, the NRC completed an inspection at your Point Beach Nuclear

Station. The results of this inspection were discussed on that date with Mr. Fred Cayia

and other members of your staff. The enclosed report presents the results of that

inspection.

!

Areas examined during the inspection are identified in the report. Within these areas, the

inspection consisted of a selective examination of procedures and representative records,

observations, and interviews with personnel. Overall, radiation protection controls for

steam generator work were effective on minimizing dose.

!

In addition, this refers to an investigation conducted by the NRC Office of Investigations to

determine if radioactive material was deliberately misused at your facility, if there was a

coverup of the alleged misuse of radioactive material, and if employment discrimination

against a contract worker occurred. The synopsis for this investigation is enclosed. The

investigation concluded that radioactive material was deliberately misused, that there was

no coverup, and discrimination against a worker was not substantiated.

Based on the results of the inspection and investigation, one violation of NRC requirements

was identified, as specified in the enclosed Notice of Violation (Notice). The violation

concerns the failure to ensure that byproduct material was possessed and used in

accordance with your facility operating license. While this failure resulted in no significant

radiation exposure, this violation is of concern because it involved the deliberate m;suse of

radioactive material. The NRC considers the deliberate misuse of licensed material to be of

significant regulatory interest, even though the magnitude of the dose was within NRC's

i

regulatory limits. We are additionally concemad that this event was not documented via

your Condition Reporting System. Our understanding of your corrective actions is

l

described in section R1.1 of the enclosed inspection report. Consequently, no reply to the

,

- violation is required and we have no further questions regarding this matter at this time.

Two instances where unauthorized personnel partially crossed high radiation area

boundaries were also reviewed. Although no violations of NRC requirements or of your

procedures were identified as a result of these events, the plant manager and radiation

,

protection manager indicated that these actions clearly did not meet their expectations

!

regarding high radiation area controls. These events are of particular concern to us

'

because high radiation area boundary violations have been documented in two previous

reports and these events indicate a continuing lack of attention by PBNP personnel to the

controls in place for work in and around high radiation areas.

)

There are also weaknesses in your programs for the use of protective clothing and frisking

for personal contamination. This included allowing persoin el to leave designated

'

contaminated areas in protective clothing (overalls) and don personal clothing prior to using

contamination monitors.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter

will be placed in the NRC Public Document Room.
