SUBJECT: NOTICE OF VIOLATION

(INSPECTIONREPORTNOS. 50-250/85-21AND50-251/85-21)

This refers to the special inspection conducted on May 22-24, 1985, at the Turkey

Point Nuclear Plant to review the circumstances surrounding the failure to

implement approved compensatory measures in a timely manner in connection with a

planned outage of the security computer. This event, which resulted from

inadequate relaying of information between the Central Alarm Station operator

and security supervisors, was discovered by licensee security personnel. It is

noted that Unit 3 was in the refueling mode and Unit 4 was at 100 percent power

at the time. An Enforcement Conference to discuss this matter was held in the

Region II Office on June 4,1985.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1955), the violation described

in the enclosed Notice has been classified as a Severity Level III violation.

Normally a civil penalty is considered for a Severity Level III violation.

However, after consultation with the Director, Office of Inspection and

Enforcement, I have decided that a civil penalty will not be proposed in this

case because of the unusually prompt and extensive corrective action taken and

your prior good performance in the area of concern.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your response,

you should document the specific actions taken and any additional actions you

plan to prevent recurrence. After reviewing your response to this Notice,

including your proposed corrective actions, the NRC will determine whether

further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguard:: activities and

security measures are exempt from public disclosure; therefore, the enclosures

to this letter, with the exception of the report cover page which presents a

nonexempt summary, will not be placed in the NRC's Public Document Room.
