This refers to your letter of March 15, 1985 in response to the Notice of' Violation and Proposed Imposition of Civil Penalties sent to you with our letter of February 14, 1985. The Notice concerned violations found during the special inspection of August 20-24, 1984. The NRC inspection team found seven violations involving failure to adhere to NRC regulations and physical security plans which, if each was viewed in isolation, might be categorized individually as Severity Level IV or V violations. However, the number of violations suggest a breakdown in management control and oversight of the safeguards program. The NRC believes the violations to be symptomatic of programmatic deficiencies rather than isolated occurrences.
After careful consideration of your response, we have concluded for the reasons given in the enclosed Order and Appendix that your response provided a sufficient basis for mitigation of one of the seven violations. The proposed penalty for one of the violations has been withdrawn. The remaining violations were correctly categorized and an appropriate civil penalty was proposed.
Accordingly, we hereby serve the enclosed Order on Omaha Public Power District imposing civil penalties in the amount of Twenty One Thousand Four Hundred Twenty-five Dollars ($21,425).
Your response to our February 14, 1985 letter denied certain violations and did not include discussion of corrective actions for those violations. Consequently, for those violations for which a civil penalty is now being imposed, you are required to respond with such information within 30 days to the Director, Office of Inspection and Enforcement, U.S. Nuclear Regulatory Comission, Washington, D.C. 20555 with a copy to the Regional Administrator, U.S. Nuclear Regulatory Commission, Region IV, 611 Ryan Plaza Drive, Suite 1000, Arlington, Texas 76011.
