Dear Mr. Carey:

SUBJECT:

USE OF ASME CODE CASE H-288 FOR THE BEAVER VALLEY POWER STATION UNIT N0. 1 (LICENSING ACTION TAC NO. 57933)

= By letter dated May 28, 1985 you requested NRC's authorization to use the subject Code Case. Your intent is to seek a waiver of the 100'F minimum test temperature requirements for both Class 1 and 2 components constructed entirely of austenitic materials.

Code Case N-288, " Hydrostatic Test Requirements for Class 1 and 2 Components,Section XI, Division 1" was an acceptable Code Case that was endorsed by the NRC staff in Revision 1 of Regulatory Guide 1.147. The Code Case was subsequently annulled by action of the ASME Council and was therefore deleted from the list of acceptable Code Cases in Revision 3 of Regulatory Guide 1.147. Since Ccde Case N-288 is no longer active, it may not be used by DLC at Beaver Valley Unit No. 1. The basis for the annulment of Code Case N-288 by the ASME was that the contents of the Code Case were published in revisions to Section XI, Division 1, in the Winter 1977 Addenda (Class 2) and the Winter 1981 Addenda (Class 1) of the ASME Boiler and Pressure Vessel Code.

We understand that it is the intent of DLC to only seek a waiver of the 100"F minimum test temperature requirements of both Class 1 and 2 components constructed entirely of austenitic materials. You are authorized to use l

Article IWB-5000 of Section XI, Division 1, 1980 Edition as revised through the Winter 1981 Addenda for Class 1 components, and Article IWC-5000 of

. Section XI, Division 1, as revised in the Winter 1977 Addenda for Class 2 l l components or alternately Article IWC-5000 of Section XI, Division 1,1980 i Edition as revised through the Winter 1981 Addenda for Class 2 components.

! Use of these Addenda to justify the waiver should be documented in a future l amendment to the Updated FSAR.
