Gentlemen:
SUBJECT: NOTICE OF VIOLATION
(INSPECTION REPORT NO. 50-413/85-27)
A special safeguards inspection was conducted by a member of the Region II staff
on June 7-8,
1985, of activities authorized by Nuclear Regulatory Commission
(NRC) Operating License No. NPF-35 for your Catawba facility. The NRC's concern
relative to the inspection findings was discussed with you in an Enforcement
Conference held at the Region II Office on July 3, 1985.
The purpose of this inspection was to review the circumstances of a security
event reported by the licensee concerning a degradation discovered in a vital
area barrier.
The
inspection findings indicate that certain activities violated NRC
requirements. The violation, references to pertinent requirements, and elements
to be included in your response are presented in the enclosed Notice of
Violation.
In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and
security measures are exempt from public disclosure; therefore, the enclosures
to this letter, with the exception of the report cover page which presents a
nonexempt summary, will not be placed in NRC's Public Document Room.
The responses directed by this letter and the enclosed Notice are not subject to
the clearance procedures of the Office of Management and Budget as required by
the Paperwork Reduction Act of 1980, PL 96-511.
