HUGH GILMARTIN On July 19, 1995, GILMARTIN was interviewed by the re v rting investigator.
The ' interview was conducted under oath at the New Yorc Power Authority (NYPA),

reorganization, the Configuration Management Group Department. Those consisted of 3 managers, Bill LEMANSKY, Dick BECHT, and Ulrich WITTE.
three managers reported.to Alan ETTLINGER. As part of reorganization, the group's responsibilities were realigned, which led to WITTE's position being eliminated. GILMARTIN said that WITTE was not chosen to be one of the two remaining managers because: I) in the selection process, GILMARTIN tasked the e three managers to rank the people assigned to them, and WITTE did not providee clear and succinct information; 2),WITTE was found to be lacking in providing E information on the status of work; 3) ETTLINGER did not think favorably of . ?E WITTE; 4) WITTE had developed a reputation for not being a team player; and GILMARTIN said that 32 S5) problems with WITTE's travel expense statements.
DOUGHERTY agreed with his decision to not select WITTE.

had raised FP issues.
GILMARTIN recalled that, for a short period of time, he was responsible for the construction of an administration building at the James A. Fitzpatrick (JAF) Nuclear Generating Station. During that time, BARTLIK raised issues that the building's FP system did not meet code requirements. GILMARTIN said i
i that, as a result of that concern, NYPA had their code compliance group look at it and determine that the building met the code. GILMARTIN does not think that BARTLIK ever accepted that determinad on, but believed that issue was BARTLIK raised the subject again "put to bed" approximately one year ago. GILMARTIN i

l GILMARTIN said that DOUGHERTY asked him to try to resolve the issue.
GILMARTIN got the people together again, and it was decided that they needed
( to know what the problems were and that they needed to be documented.
GILMARTIN said that he has tried to get BARTLIK to document his concern, but l
BARTLIK has not responded to the request. GILMARTIN said that he did not send BARTLIK a document requesting that he document his concern with the issue.

GILMARTIN was then questioned regarding whether he conducted an investigation into TARPINIAN's and STRAUSSER's backgrounds. GILMARTIN said that there were change orders (attached) to pay contractors, someone wanted to extend STRAUSSER and TARPINIAN before he (GILMARTIN) took his current position.
GILMARTIN opined that the change orders came to his attention in October 1994.
During that time, he was assisting DOUGHERTY in the Nuclear Engineering and Design (NED) reorganization. The change orders were left on DOUGHERTY's desk'.
He and DOUGHERTY did not know what TARPINIAN and STRAUSSER were doing for NYPA-GILMARTIN at that time, so they wanted to get an idea of their capabilities.

GILMARTIN explained that when a change order is brought to a NYPA Vice l
President, people generally ask questions and information is needed before decisions can be made. GILMARTIN added that NYPA was under financial constraints at that time.
GILMARTIN knows that Ken VEHSTEDT complained about everyone at the NYPA White Plains Office (WPO), generally stating that, "you guys are real pains in the rear end." GILMARTIN said that the general complaint from IP3 and JAF was

i l l*' Mr.'Tarpinian is uniquely qualified for this assignment due to his familiarity with the IP3 k Fire Protection Program and his participation in the preparation and subsequent completion l of the JAF Fire Protection Design Basis Documents upon which IP3's documents are based.
In addition, Mr. Tarpinian is directly responsible for the preparation of IP3 fire protection close-out packages which are being prepared for the NRC fire protection faWon during the first quarter of 1995.
Mr. Tarpinian's services were previously provided through Cataract, Inc. Since the Cataract
! contract with NYPA expires on December 31,1994, this contract rei luisition requests that Mr. Tarpinian be switched to the Vectra Fire Protection General Services Agreement contract. Mr. Tarpinian was selected based on a review of resumes of submitted by various firms contracted with NYPA to provide engineering idwnnel.
