CHRISTOPHER W. BOHLEN, being first duly sworn and under oath, deposes and says as follows:

1. I am a duly licensed and practicing attorney in the County of Kankakee, State of Illinois and have been since September, 1977.

2. In that capacity I was employed by various landowners or Rockville Township, Kankakee County to represent them in connection with certain Petitions to Condemn for the purpose of construction of an electrical transmission line in Rockville Township to be constructed by the Commonwealth Edison Company.

3. At the time of neogtiation regarding the construction of the proposed line, I negotiated with Commonwealth Edison representatives not only regarding the 345 KV line which was the subject of the Petitions, but also, at their request regarding a wider easement for the construction of a 765 KV line as well.

4. At and during the time of our negotiations, much discussion was had reagarding the 765 KV line due to various clients concerns about the location of the line and the effect of the line on their property.

5. In two instances, on behalf of Leo and Alta Walsh and on behalf of Bob Neiner Farms, Inc., we had discussions because-the easement was such that the 765 KV line was to be constructed next to the section line, while the 345 KV line was to be constructed 145 feet from the fence line,. leaving a 145 foot easement for which no compensation would be paid untile the 765 KV line was constructed.

6. During the negotiations, I was informed by representatives of the Commonwealth Edison Co., that the 765 KV line was going to be built in the near future and that for that reason the company was interested in acquiring the full easement rights for both line at the same time, if possible.

7. At no time was I ever informed that the building of the second line was dependent upon any construction at the Braidwood Power station other than that construction which was in progress at the time the Petition to condemn was filed.

8. That based upon my negotiations and the representations made to me by the various representatives of Commonwealth Edison Co.,

it was my belief that the first line was to be operable by Spring 19,,86 and the second line would be constructed shortly thereafter.
