SUBJECT:
EXECUTIVE ORDER 12498, REGULATORY PLANNING PROCESS Recently, at an EDO Staff Meeting,the question arose as to whether independent regulatory agencies such as NRC would be requested to comply voluntarily with Executive Order 12498, Regulatory Planning Process, as they had with Executive Order 12291.
Under Executive Order 12498, each agency is required to submit to OMB by February 19, 1985 a " Draft Regulatory Program," which is to discuss the agency's significant regulatory actions, and show how those actions are consistent with the Administration's regulatory principles. The " Draft Regulatory Program" will be reviewed by OMB and, when approved, will be published as part of the " Administration's Regulatory Program for 1985."
The enclosed OMB Bulletin 85-9 implements Executive Order 12498.
Section 4, on page 2 of the Bulletin, lists the agencies covered.
Independent Regulatory agencies such as the NRC are not included, and will not be asked to comply voluntarily with the Executive Order. This was confimed in an address by Bob Bedell, Deputy Administrator of the Office of Infomation and Regulatory Affairs, OMB, before the DC Bar Association on January 10, 1985, and in discussions with Jeff Hill, OMB's Desk Officer for NRC.
