SUBJECT:

DELAY IN CONDUCTING EMERGENCY EXERCISE (TAC NO. L30909)

Dear Dr. Reda:

In accordance with your application dated September 25, 1996, and pursuant to Part 70 of Title 10 of the Code of Federal Regulations, Material License' SNM-1097 is hereby amended to grant a one-time exemption from the requirement of 10 CFR 70.22(i)(3)(xii) with respect to the completion date of your next biennial emergency exercise.

Accordingly, Safety Condition S-1 is revised to include the date of September 25, 1996, and Safety Condition S-4 is added to reflect the exemption, and reads as.follows:

S-4 Notwithstanding the requirements of 10 CFR 70.22(i)(3)(xii) to conduct a biennial emergency exercise (BEE), the licensee may delay until June 30, 1997, its next scheduled BEE. All future BEES shall be based on the June 30, 1997, date.

All other conditions of this license shall remain the same.

Enclosed are copies of the revised Materials License SNM-1097 and the Safety Evaluation Report, which includes the Categorical Exclusion determination.
