DELAY IN CONDUCTING EMERGENCY EXERCISE

BACKGROUND i 10 CFR 70.22(i)(3)(xii) establishes a requirement for a biennial onsite

DISCUSSION i

GE has requested a delay in conducting its biennial emergency exercise, based on the Department of Emergency Management for New Hanover County, informing

them that they could not participate in the October exercise due to the two recent hurricanes. In addition, GE has relayed a request from New Hanover

. County, that the biennial exercise for GE be moved, such that the GE and Brunswick Nuclear Power Plant drills are held in alternate years. The NRC i staff has determined that the licensee's request is justifiable and approval j of the delay for completing the licensee's next biennial emergency exercise 4

will not adversely affect the public health, safety or the environment.

ENVIRONMENTAL REVIEW The staff has determined that the proposed changes are procedural in nature i '

and do not adversely affect public health and safety or the environment.

Therefore, in accordance with 10 CFR 51.22(c)(11), neither an environmental assessment nor an environmental impact statement is warranted for this action.

CONCLUSION Based on the above discussion, the staff concludes that the licensee's request is warranted and that its approval will have no adverse effect on public health and safety, or the environment. Therefore, the licensee's request for a delay in completing its next biennial emergency exercise is granted by adding the date of September 25, 1996, to Safety Condition S-1 and by adding new Safety Condition S-4, which reads as follows:

S-4 Notwithstanding the requirements of 10 CFR 70.22(i)(3)(xii) to conduct a biennial emergency exercise (BEE), the licensee may delay until June 30, 1997, its next scheduled BEE. All future BEES shall be based on the June 30, 1997, date.

The Region II staff has no objection to this licensing action.
