UNITS 1 AND 2 (TAC NO. M94881)
Dear Mr. McCoy:
l This letter is a request for justification for retaining the provisions of the Vogtle Electric Generating Plant (VEGP) Final Safety Analysis Report (FSAR) that state that the requirements of the containment isolation valve technical i
specification (TS) are not applicable to certain containment isolation valves, j
and that the appropriate system TS would be used instead.
It provides the status of the staff review of this item as discussed in the September 25, 1996, cover letter for the VEGP TS conversion.
For an extended period of time beginning in late 1994, Vogtle Unit I was operating with valve 1-HV-1806, a Nuclear Service Water Containment Cooler (NSCW) supply valve, in a degraded condition. Specifically, the valve would not fully shut. This valve is the containment isolation valve for the NSCW supply into the containment for safety-related containment coolers 1 and 2.
The situation was described in NRC inspection report Nos. 50-424/95-27 and 50-425/95-27, dated December 1, 1995. Although the degraded condition was subsequently fixed during a March 1996 refueling outage, the problem raised a concern about the relationship between the Vogtle FSAR and the TS used to support continued plant operations with the valve in a degraded condition.
Valve 1-HV-1806 is identified as a containment isolation valve in the system drawing and in the FSAR.
However, there is a footnote to FSAR Table 16.3-4, which states that for this valve and several other valves, the requirements of TS 3/4.6.3, Containment Isolation, do not apply. The footnote refers to TS 4.7.4, which requires that the NSCW be operable. As long as valve 1-HV-l I
1806 is open, this requirement is met and no further action is required.
However, the safety function of containment isolation may be lost any time the valve fails to fully close.
This situation appears to have been part of the original licensing basis for

If you choose to retain the footnotes, the staff will review your justification and consider whether a backfit, under the provisions of 10 CFR 50.109, to require removal of these footnotes, is appropriate.
