I With reference to your Note of 9/20 to Dr. Spangler (enclosed),
which was forwarded to me by Dr. Spangler, I would like to offer 4
the following observations.
i Wnen Mr. Grainey of your staff requested Projects to arrange for i
development of such testimony n few weeks ago, Mr. Levan pointed out-that'a) since'it was not an issue in.the case, having been specifically thrown out by the Board which cited the review carried out previously i

-in the Prarie Island proceeding, and b) since the issue of energy con-servation-is-not germaine to an operating plant (see the Comunissions order in Midland) it seems quite unlikely that it would be raised as a question by the lloard.
As such, we did not view the preparation of testimony or provision of a witness on a highly speculative basis 1-as a proper use of Reg's liuited manpower and dollar resources, parti-cularly since, if in the-unlikely event that the questions were raised, it could be answered-in short order by a communication to the Blard.
j I feel quite strongly that if you wished to pursue the matter further, the appropriate route would have been-with Reactor Projects rather than-j with Dr. Spangler.
I have indicated to Dr. Spangler that as far as I am concerned, provision of a' witness will not be necessary.
I will be happy.to discuss this matter with you in more detail, and to arrange meetings with higher management if you believo it to be necessary.
