Office of liuclear Reactor Regulation Items of Interest Week Ending January 8, 1993 (alvert Cliffs Units I and 2 Both units are currently operating at 100% power.

A group of Japanese Government officials and representatives of Japanese nuclear industries will visit the Calvert Cliffs Nuclear Power Plant on 01/14/93. The delegation will be received in Washington D.C. on 01/13/93, for discussions on international physical protection standards and guidelines by representatives from the Departments of Energy, Defense. State and the Nuclear  !

Regulatory Commission. The site tour to Calvert Cliffs will provide the Japanese with opportunities to see and to discuss physical protection with security managers and operators within the United States.

Palisades Plant Consumer's Power Company formally acnounced that it will not continue to pursue an agreement with Bechtel Power Corporation and Westinghouse Electric Corporation for the formation of the Palisades Generating Com)any. The reasons given for the decision are consumers' confidence in tie continued good performance of the plant and the diminished opportunity for the sale of the plant.

Meetina with TVA's Watts Bar Manaoement on the Status of Watts Bar Unit 1 On January 5,1993, the Associate Director for Inspection and Technical Assessment, the Director, Division of Reactor Inspection and Licensee Performance and the Chief, Performance and Quality Evaluation Branch attended a meeting with TVA's Watts Bar management to discuss the licensee's current status and schedule for completion of Watts Bar Unit 1. Senior management representatives from NRR projects and Region 11 also attended. Among the subjects discussed was the staff's review of Quality Assurance records and material traceability issues. A followup meeting will be held with Watts Bar to further discuss corrective action proposals in these areas.

DOE Contractor Briefina On December 31, 1992, a member of the Human factors Assessment Branch provided a briefing to a Department of Energy (DOE) contractor who is about to conduct reviews of some DOE facility control rooms. The major emphasis in the briefing was the NRC regulation and guidance used in the conduct of the detailed control room design reviews and safety parameter display system reviews resulting from the Three Mile Island accident, and the review guidelines being used for advanced reactor control room reviews.

Week Ending January 8, 1993 .j FUREG on Lockina Systems Published NUREC/CR5929, " Locking Systems for Physical Protection and Control" was recently published by the Division of Safeguards and Transportation, Office of Nuclear Material Safety and Safeguards. The document was developed by Sandia National Laboratory. Portions of the technical information found in the NUREG will be used to update Regulatory Guide 5.12, " General Use of Locks in the Protection and Control of facilities and Special Nuclear Materials".

Plutonium Air Shioment lhe final report, " feasibility Studies for the Controlled, Cruise-Altitude Drop, and Aircraft Crash Tests", was provided to the Power Reactor and Nuclear fuel Development Corporation of Tokyo, Japan on December 31,1992. The report was prepared by Lawrence Livermore National Laboratory (LLNL) under Nuclear Regulatory Commission contract and details results of the activities conducted. Emphasis is placed on performing a controlled test to satisfy the -!

requirements for packages for air transport of plutonium from one foreign country to another when these shipments pass through U.S.-airspace.

Recent U.S. Department of Enerav. Site Characterization Submittal.1 i On December 10, 1992, transmitted " Progress Report on Site Characterization: the Department Yucca of EnergyNeva Mountain, (DOE) da, Number 6" for review.

" Site Characterization Progress Repert: Yucca Mountain,-Nevada, Number 7" was received by the staff on December 31, 1992. These two resorts describe the progress of site-characterization for the aeriods of Octo)er.1,1991 -

March 31, 1992, and April 1, 1992 - Septem)er 30, 1992, respectively. Semi- '

annual reports of progress are required by 10 CFR Part 60 and should include significant results of site characterization work completed, the. status of all site characterization activities and study plans under development,- and details of site monitoring activities. Nuclear Regulatory Commission staff will review these reports to determine if DOE has been responsive to staff comments on previous Progress Reports and to determins if these most recent. -

reports'are responsive-to the staff's request that DOE also discuss progress toward the resolution of NRC Site Characterization Ar,alysis concerns and any .

concerns regarding DOE study plans. .

In addition to the Progress Reports, in the month of December, DOE also transmitted six site characterization study plans for the staff's review and plans to issue six additional study plans prior to February 1993. DOE will request that the staff expedite reviews of five of these study plans that deal with tests to be conducted in the Exploratory Studies facility, Update on a Site Decommissionina Mangqement Plan Site: Confirmatory Survey for the Texas Instruments Burial __ Site. Attleboro. Massachusetts Texas Instruments (TI), owner of the- Attleboro Massachusetts, site listed on the Site Decommissioning Management Plan (SDMP), has conducted remediation and JANUARY 8, 1993' ENCLOSVRE B

., 2 a radiological survey of the 1600 m' burial site (the total affected area is -

about 2.5 acres). Under contract with the Nuclear Regulatory Commission, Oak t Ridge Institute for Science and Education (0 RISE) conducted a confirmatory survey of the site on December 15-16, 1992, and found some radiological contamination in excess of existing NRC guidelines. Il plans to finish remediation of the site and complete a final survey by April 1993.

As background information, from 1952 to 1959, Metals and Controls fabricated l uranium foils for reactor experiments and fuel for the U.S. Navy at the  :

Attleboro site. After merging with Tl in 1959, the site continued to fabricate reactor fuel cores, and also some source materials for commercial use until 1974. There were burials made between 1958 and 1961, and the burial site was closed in 1967. The interior of the buildings on site was decontaminated and released for unrestricted use by NRC in 1983.

Nebrasig Asks to Eliminate Boyd County Low-Level Waste Disnosal Site Nebraska Governor Nelson, in a December 23, 1992, letter to the Central Interstate low-Level Radioactive Waste Compact Commission, asked the Compact Commissioners to withdraw Boyd County from consideration as the final low-level waste (LLW) disposal site for the Compact. Further, Governor Nelson ,

requested the State Attorney General to pursue legal avenues if the Compact does not withdraw the site by January 8, 1993. The Governor's request stems from a strong vote against consent for this project and the fact that community consent for the project has not been obtained from the citizens of  :

Boyd County as required by Nebraska law.

Update on Rancho Seco Decommissionino On January 5,1993, the Division of low-level Waste Management and Decom-missioning (LLWM), completed the Safety Evaluation Report and Environmentc1 Assessment for the first two phases of decommissioning of the Ranch Seco  !

Nuclear Generating Station (RSNGS). The licensee proposed decommissioning

  • RSNGS using two subcategories of the SAFSTOR alternative. Initially, the. '

licensee will place the plant into a Custodial-SAFSTOR configuration which will last until all spent fuel is removed from the spent fuel-pool. Upon resolution of all issues associated with spent fuel and the transfer cf the spent fuel to an onsite independent spent fuel storage installation, the licensee will begin the peocess of placing the plant into a Hardened-SAFSTOR '

condition. RSNGS will renain in that condition until the year 2008, when Deferred-DECON dismantlerent of the plant will begin. Specific details ,

associated with potential environmental impacts during dismantlement of the plant will be addressed in a future supplement to the RSNGS environmental report.

Office for Analysis and Evaluation of Operational Data Items of Interest Week Ending January 8,1993 Diaanostic Evaluation and incident Investiaation Branch (DEllB)

The incident Investigation Team (llT) continued its investigation efforts involving the potential overexposure of a nursing home patient, as well as other Individuals who may have come in close proximity to the. unshielded source. The majority of the team members are in Bethesda preparing the llT report. A team member went to the Omnitron facilities in Houston, Texas where the High Dose Rate Afterloading device is minufactured and the company's corporate offices are located. Test results from Omnitron and the NRC's consultant, Southwest Research Institute, are being reviewed. A team member will attend a meeting between Omnitron and the Food and Drug Administration at Omnitron International's Headquarters on January ll,1993. The Commission briefing for the Ili is scheduled for february 8.

,, Office of Administration items of Interest Week Ending January 8, 1992 Contraci Awards The General Services Administration has awarded the NRC Guard contract to United International Investigative Services (UllS) of Anaheim, CA. The current contract with Guardian Security Agency, Inc. was due to expire fiovember 30, 1992, but was extended for 60 days to allow the new contractor to hire staff and obtain the necessary security clearances. (Guardian was bought out by Wells Fargo.) The new contract is due to start on February 1, 1993.

As of January 1,1993, UllS planned to employ 43 of the 55 existing guard pnsonnel. An announcement for headquarters employees will be prepared and W stributed prior to February 1, 1993. -

fur contract awards in the amounts of $421,909, $318,401, $289,586 and

$269,359 respectively, were made on December 29, 1992 to Government Telecommunication, Inc. for telephone switching systems. The systems will be installed in the f4RC Headquarters Operations Center and in Regions 1, Ill, and V. These systems will modernize and enhance the existing telephone operations in each of the above organizations.

Air Quality Studiet T1e Division of Contracts and Property Management and the Office of Consolidation held a meeting on January 7,1993 with the National Institute of Standards and lechnology to review the scope of work for performing indoor air quality studies in Two White Flint florth. The studies will be used to ensure that the air quality meets established Federal standards prior to occupying the new building.

Lisbon Nqclear Safety initiative _

The Division of Contracts and Property Management has initiated work on a contract and a cooperative agreement for the purpose of aiding Russia and the Ukraine in improving the safety of their nuclear power plants. This effort is being undertaken in conjunction with the Lisbon Nuclear Safety Initiative.

DOE laboratory Pilot Proiect On January 4, 1993, Division of Contracts and Property Management (DCPM) staff began a six month pilot project to provide on-site assistance to the Office of Nuclear Regulatory Research (RES). The team will conduct reviews of project files and recommend improvements in the management of laboratory projects consistent with sound contracting principles. DCPM will also provide assistance in the negotiation and administration of projects as requested by the RES staff. During the pilot project, DCPM staff will use draft Management Directive 11.7 as guidance in providing assistance to RES.

NRC has been advised that on January 6, 1993, the President signed the Executive Order (E.0.) entitled, " National Industrial Security Program." This program is designed to simalify and consolidate security policies and procedures ap>l1 cable to t1e safeguarding of Federal Government classified information t1at is released to contractors, licensees, and grantees of the United States Government. NRC was involved and contributed to the development of the NISP Operating Manual which is currently being coordinated within NRC for review and comment. The Manual which requires the concurrence of NRC, shall be issued no later than one year from the issuance of the E.0.

[omputer Security The Office of Information Resources Management (IRM) staff responded to a Hot Line virus call on December 29, 1992. The problem was on the 13th floor of One White flint North, and involved a networking microcomputer. The network virus detection program detected the virus during the logon process. The virus was identified as the Green Caterpillar virus. Using F-Prot, the virus was eradicated.

IRM Adoots Policy to Promote the Vse of E-Ma.il The Office of Information Resources Management is adopting the policy that IRM supervisors and managers use E-Mail to communicate routine information.

Information that thould be communicated via E-Mail includes:

- Miscellaneou, informal electronic mail messages from one individual to another that Jo not contain information on or result in agency policy.

- Transitory communications that have short-term value, no documentary value, or quasi-official notices that do not serve as the basis for official actions.

- Routine IRM information that does not require formal documentation or concurrence, and IRM program information for which the record content is summarized or duplicated in the official files.

- Administrative information, including delegations of authority, plans of the day, and other communications to accomplish routine administrative actions. _

- Draft documents circulated for informal editorial review, convenience, or reference.

IRM is also requiring that the E-Mail system be checked each morning and afternoon to ensure prompt retrieval of transmitted information.

Office of Personnel items of Interest Weck Ending January 8, 1993 Employee Assistante Proaram Manaaers Meet On January 7. Pat Kaplan attended a meeting of Federal Employee Assistance Program (EAP) Managers to plan a strategy for advisirg the Office of Personnel Management (OPM) about substance abuse and mental health coverage under the federal Employee Health Benefits Program. Although the Drug-Free Workplace program requires that known alcoholics and illegal drug users be referred for appropriate treatment, often such treatment is either not covered under the employee's health plan or is inadequate for the needs of the individual. The group will advise OPM of the impact the limited coverage has on the ability of EAP's to fulfill the legislative mandate to maintain a drug-free workplace and help employees to achieve and maintain their f ull productivity. -

Office of Enforcement Items of Interest Week Ending January 8, 1993 31,cqtficant Enforcement Actions:

1. A Notice of Violation and Proposed Imposition of Civil Penalty in the amnunt of $375 was issued by Region 11 on January 5, 1993, to Geo Cim, in ., Hato Rey, Puerto Rico. The action was based on a Severity Level 111 /lolation for failure to properly secure a moisture density gauge.

The gauge was in the back of an open-bed pickup truck parked on a residential street, and was neither properly secured nor under constant surveillance by the licensee. The box containing the gauge was not locked, and the key to the gauge was in the box. The base civil penalty af $500 was mitigated 25 percent, based on 50 percent escalation for NRC -

identification, 25 percent mitigation for corrective actions, and 50 (

percent mitigation for licensee performance. Two other violations were also cited at Severity Level IV. U (EN 92-104)

amount of $37d was issued by Region 11 on January 5, 1993, to Caribbean u Soil Testing Company, Inc., San Juan, Norto Rico. The action was based on a Severity Level Ill violation # ilure to properly secure a ,

moisture density gauge. The gauge was stolen from a licensee truck parked in front of the licensee's f.cility. The gauge, still locked, was recovered by the police three days later. The base civil penalty of

$500 was mitigated 25 percent for corrective actions, The other factors were considered but no further adjustment was warranted. A violation for failure to report the theft imm?diately by telephone was cited at Sevc ity Level IV. The licensee notified NRC by letter dated the day of the theft. (EN 92-105)

3. A Notice of Violation and Proposed Imposition of Civil Penalty in the ,

amount of $250 was issued on January 8, 1993, to P. S. Scott Associates, --

Alpe'u, Michigan. The action was based on the licensee's failure to maintain control of licensed material when a soil moisture density gauge was moved af ter the authorized user lef t the gauge unattended. An individual moved the gauge away from an excavation in order to operate heavy equipment and repositioned it at a safer location at the construction site. The individual who moved the gauge was not an

.mployee of the licensee or an authorized user. The 5500 base civil penalty was escalated 50 percent for NRC identification and mitigated 100 percent for the licensee's good past performance'. (EN 93-001)

4. An imposition of Civil Penalty in the amount of $2,000 was issued on January 6, 199: to Baystate Medical Center, Inc., Springfield, Massachusetts. The action was based on two violations of NRC requirements regarding the licensee's Quality Management Program (10 CFR 35.32). These violations contributed to a misadministration in which a patient was given 4.1 millicuries of iodine-131 for a thyroid uptake study instead of the intended dose of 16 microcuries. (EN 92-064A)

1. Philadelphia Electric Company (Limerick) paid the civil penalty in the amount of $52,500. The action was based on an event at Limerick involving unplanned radiation exposure to plant personnel working in the Unit I drywell during low power operation. (EA 92-179)
2. CTI, Inc., Martinez, California, paid the civil penalty in the amount of

$12,500. The action was based on violations involving the lic:nsee's failure to (1) use a separate alarm ratemeter, (2) conduct complete radiation surveys, and (3) pose high radiation areas. (EA 92-127)

3. Wolf Creek Nuclear Operating Corporation (Wolf Creek) paid the civil i

penalty in the amount of $50,000. The action was based on a violation of the licensee's work control program which resulted in the degradation of the essential service water systcm. (EA 92-191) __

Office of Consolidation Items of Interest Week Ending January 8, 1993 191ond Buildina Status Base building systems inst 111ation for TWFN is continuing with installation of electrical systems, water 4.nd sewer service, Heating, Ventilation and Air-Conditioning (HVAC) systems and elevator systems as well as lobby granite and marble work and core partitioning around mechanical rooms and stairwells.

Elevator guide rails, cab, and doors for the traction elevator are installed and guide rails, doors, frames, and cables are being installed for the main lobby elevators.

On January 6, in response to the NRC's request for additional space, GSA formally solicited a proposal from the Tower Companies for an additional 19,000 square feet of office and related space at TWFN. The additional space would meet the NRC headquarters needs for a full-service cafeteria, fitness center, health unit, credit union, and storage space.

On January 8, the interior design and spac: planning contractor, DBI, made a presentation of its proposal for the design and furnishing of the auditorium space to the NRC Auditorium Committee and Office of Consolidation staff. 0B1 also presented design proposals for finishes and furniture for the exhibit area on the Plaza level.

On January 8, Consolidation staff met with Office of Personnel (0P) staff and OP's audio-visual design consultant to discuss training center audio-visual systems. The OP staff proposed changes which will require modifications to DBI's interior design plan for the training center.

Secretary of Enerav Advisory Board Meetina Maria Lopez-Otin, Federal Liaison, attended the full meeting of the Secretary of Energy's Advisory Board (SEAB) on January 8, 1993. The meeting was opened by Secretary Watkins, who stayed.and participated throughout the session. Of l

> interest to the NRC was the presentation by the Task Force on Radioactive Waste Management on its Draft Final Report. The Task Force was charged by the Secretary to make recommendations that might strengthen public trust and confidence in the Department's radior.ctive waste management program. The recommendations contained in the draft report."... represent the panel's recipe for what the Department should do to strengthen public trust and

- confidence..." The Board also heard public comments on the report which focused on initiatives DOE should take to implement those recommendations.

The Board also presented to the Secretary the report of the Task Force on Economic Analysis and Modeling Related to Energy entitled: " Economic Policy Analysis in DOE: A Blueprint for Develo'pment". Also available at the meeting was Secretary Watkins' Posture Statement for D0E. .

1. Yale-New Haven and American Cyanamid Enforcement Conferences On January 6,1993, the Region I Divi',lon of Radiation Safety and

~

Safeguards conducted two enforcement conferences. The Deputy Director,. ',

DRSS, led the conference with Yale-New Haven to discuss a therapeutic misadministration that occurred on December 2, 1992 at the New Haven facility. The Branch Chief, Nuclear Materials Safety Branch, led the conference with American Cyanamid to discuss management oversight and-involvement in the licensee's research and development activities at their Princeton, NJ location. Enforcement actions for both of those cases are pending.

2. Salem The NRC Augmented Inspection Team, which reviewed the December 13, 1992, annunciator system failure at Salem, conducted a- formal exit briefing with Public Service Electric and Gas (PSE&G) Company on January 7, 1993. '

The meeting was open'to the public and was held at PSE&G's Processing Center on-site. The AIT has identified that the cause of the event involved design problems associated with the computer controlled annunciator system and failure of the operators to follow the procedures associated with system operation.

1. Ignnessee Valley Authority - Watts Bar On January 5, the Regional Administrator; the Associate Director for Projects, NRR; and the Associate Directcr for Advanced Reactors and License Renewal, NRR, were at the Watts Bar site to discuss the status of project completion for Unit 1.
2. Radiation Sterilizers. Inc.

On January 5, the Environmental Protection Division of the Georgia Department of Natural Resources and the U.S. Department of Energy held a press conference on January 6, 1992, to announce the completion of cleanup activities at Radiation Sterilizers, Inc. (RSI). RSI had operated a medical equipment sterilization component in Decatur, Georgia from 1985 until a contamination event in June 1988. At the State of Georgia's request, Region li participated in a task force that evaluated the recovery actions after the 1988 contamination event. The Director, Division of Radiation Safety and Safeguards and the Agreement State officer were in attendance at the press conference.

3. Japanese Visitors On January 8, Mr. Takasi Imanaga, General Manager of Japan Electric Power Information Center, Inc. (JEPIC) and Mr. Ikira Kanazawa, Deputy Director of Engineering Division, Public Utility Department of MITI visited in the Region 11 Office.

1.- City of Columbus. Ohio On January 6, 1993, an Enforcement Conference was conducted 'q between representatives of the City of Columbus, Ohio, Division of  !

Construction Inspection (NRC License No. 34-13103-02) and members :i of the Region 111 staff. The purpose of the conference-was to 1 discuss the findings of an inspection conducted July 23 and 25, i 1991, and a subsequent investigation conducted by the NRC Office of Investigations. The major issue discussed was the unauthorized i removal of source rods from moisture / density gauging devices.  ;

This is being considered for escalated enforcement. The licensee's corrective measures to prevent recurrence were discussed and determined to be adequate.

2. G. R. Osterland Comoany On January 7, 1993, an Enforcement Conference was conducted  ;

between a representative of G. R. Osterland Company (NRC License No. 34-26037-01) and members of the Region III staff. The purpose of the conference was to discuss the findings of an inspection conducted December 7, 1992. The major issue discussed was the failure to maintain constant surveillance and immediate control of licensed material which resulted in subsequent damage to the device 5 This is being considered for escalated enforcement. The licensee's corrective measures to prevent recurrence were discussed and determined to be adequate.

3. Cleveland Electric illuminatina Comoany. Perry Station On January. 7,1993, the Acting Deputy Regional Administrator, the-Acting Division Director, Division of Reactor Safety, and other NRC staff members met with the Perry Station Manager of-Engineering and other licensee representatives to discuss current issues of mutual- interest. -The discussions mostly focused on several recent situations where the NRC questioned the appropriateness'and conservatism of Perry engineering evaluations.
4. Di C. Cook Nuclear Plant The Regional Administrator, and Deputy Director, Division of Reactor Projects and other NRC staff members met with licensee plant management for the D. C. Cook Nuclear Plant on January 8,-

1993, for an Enforcement Conference. . The purpose of the conference was to address apparent violations relating to an extended. period of inoperability of an emergency diesel generator.

- 1, Washinoton Public Power Sunoly System A combined team from the Special Inspection Branch of NRR and the Reactor Safety Branch of RegionLV is onsite at Washington Nuclear ~ Plant- Number. 2, preparing for the service water functional inspection February 1-15, 1993.

2. Eprtland General 11ectric Comoany The Board of Directors of Portland General Electric decided on Monday, January 4 that the Trojan Nuclear Plant will not be restarted. The plant-had shut down on November 9, 1992 because of a leaking steam generator tube. The licensee had previously announced plans to phase out operation of Trojan in 1996. In' announcing the decision not to restart the plant, the PGE President stated that " Closing Trojan now is the least-cost decision, given all available information." The licensee cited excess power available from California and short-term savings. to'be realized by terminating contract help, along with regulatory uncertainty related to differing technical views within the NRC.
