MONTICELLO NUCLEAR GENERATING PLANT - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO. M84515)

By letter dated September 16, 1992, and supplemented November 3,1992 you submitted an application for a license amendment to the Monticello Operating License. You requested that Exhibits D and E of your application be withheld from public disclosure pursuant to 10 CFR 2.790. The documents for which you requested proprietary handling is identified as " Maximum Extended Load Line Limit Analysis for Monticello Nuclear Generating Plant, Cycle 15, NEDC-31849P" and " Safety Review for Monticello Nuclear Generating Plant, increased Core Flow Operation Throughout Cycle 14 - NEDC-31778P "

Your affidavits stated that the documents qualify for proprietary handling because they contain information customarily held in confidence by General Electric. The documents have consistently been held in confidence by General Electric Company, no public disclosure has been made, and they are not available in public sources. Public disclosure of the information to be withheld is likely to cause substantial harm to the competitive position of the General Electric Company and deprive or reduce the availability of profit making opportunities. A substantial effort has been expended by General Electric to develop this information.

We have reviewed your request and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis our review, have determined that the submitted information does contain proprietary commercial information. Therefore, Exhibits D and E of your submittal will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section-103(b) of the Atomic _ Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants. working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
