' issues that arise out of each of the agency's involvement with the standards.

. Conflicting schedules due to different agency's priorities 1

j' As a result of this meeting Mr. Cannon appears to be quite agreeable that our staffs work on two areas in an attempt to resolve t'.ese three issues.

The first arear.1.s to have the staff develop a possible legislative fix re- -

, garding application of the Resource Conservation au Recovery Act to low level radioactive waste disposal and uranium mill tailings. In doing so this would help clarify the dual regulatory involvement in these two areas.

This act is currently before Congress for reauthorization. Cannon said that

! while he could not speak entirely for EPA he felt they would not object to j our seeking congressional clarification.

The second area dealt with the staff working together to prepare an umbrella i memorandum of understanding outlining the interface between the two agencies.

The staff, as a part of this effort, will attempt to incorporate the various l

MDU's we had been pursuing with EPA on specific limited areas of our inter-

face.

I There was general agreement by both staffs that you and Mr. Ruckelshaus ,

should meet. We will provide you an update on specific positions for a meeting in March. l

Dear Mr. Ruckelshaus:

I have been looking forward to meeting ever since your appointment as EPA Administrator and would like to do so in the near future to continue the top-level close working relationship between the NRC and EPA in areas of mutual interest that has existed in the past.

l I believe that a meeting at this time would be particularly useful as a vehicle for addressing policy issues that are Issues that we might now before our respective agencies.

find worth reviewing are:

-- EPA and NRC respective responsibilities in waste disposal; ,

-- General EPA and NRC responsibilities in setting radiation standards and implementing them; and

-- Possible need for a revised memorandum of l understanding between EPA and NRC.

Our two staffs are working prior to our meeting to try to I highlight specific areas where policy decisions are needed.

I will be touch with you soon to arrange the meeting.
