We are attaching copies for the Board of pages 7 through 19 of subject pleading.

For the reasons stated in the attached, we ask that these pages be held in camera

(Each page is marked " CONFIDENTIAL," which is l e only rubber stamp we were able to find which was appropriate.)

CASE's position is that the paragraph in the Board's Memorandum to which pages 7 through 19 of subject pleading apply should never have been included in the Board's Memorandum to begin with.

We certainly do not want to make it a big issue now, thereby calling additional undue attention to it.

We also believe that it is appropriate, under the circumstances, for the responses by the parties to be held in camera, and are attempting to contact counsel for Applicants and NRC Staff to discuss this.

(We have already spoken with NRC Staff counsel Stuart Treby, who agreed to keep the information which is attached hereto in camera, at least for now; we hope to discuss this further with him, so that any response by the Staff will also be held in camera. We talked with Malcolm Phillips, counsel for Applicants, on 1/4/85 about tTis, and he stated that he needed to look at the transcript and had no problem with keeping confidential anything which was not already in the record. We are not comfortable with that word, and attempted to contact Mr. Phillips today; he was out and we left word for him to call. We will attempt to reach him tomorrow morning.

.i. that it was he who prepared the findings for Applicants regarding this. (Applicants' Proposed Findings were signed by Mr. Reynolds, over the typed signatures of Messrs.

Reynolds, Philips, and Horin.)

Since we have not as yet received assurance from Applicants that they will agree to keep these pages of our pleading in camera, we are sending Applicants' copy of our pleading to the Board Chairman, with the request that it be released to Appli-cants only upon their agreement to keep it in_ camera.

We also ask that the Board order that these pages of CASE's pleading, as well as any discussion by the parties of this matter, be held in_ camera -- for official use only. We believe when the Board reviews our pleading, it will agree that this is appropriate under the circumstances.
