Dear Mr. Estridge:

This is in response to your letter dated January 25, 1996, wherein you requested permission to raise the level of the Standby Nuclear Water Pond in Lake Wylie. The result of this activity would be an increase in the Standby Nuclear Service Pond level to 574' (a 2' increase).

A review of our files indicates that a permit for the Catawba Nuclear Station was issued on February 22, 1977 (#76-2A-084). Therefore, this office is hereby granting a modification to that permit to reflect the change on the attached drawings (Sheets 1-3 of 3 dated January 25,1996). This change includes the replacement of an existing 1 foot steel plate located in the discharge headwall with a 3 foot steel or concrete plate.

Please attach this letter with the modified drawings to the original permit. All of the conditions to which the work is made subject remain in full force and effect. In that this work appears subject to the jurisdiction '

of the South Carolina Department of Health and Environmental Control, it is highly recommended that you contact that agency to ascertain their requirements in this matter.

Duke Power Co. Catawba Nuclear Station; P/N 76-2A-084 Proposed Modification

Dear Mo. Hadden:

We have reviewed the proposed modification to the Standby Nuclcar Service Water Pond which would raise the water level in the pond by 2 feet. The applicant states that the proposed work would inundato approximately 2.07 acres of wetlands succounding the existing pond. This modification was submitted in a letter to the Corps of Engineers (COS) on January 25, 1996. The applicant states that this modification will provide additional cooling water to address operational concorno.

The Departmont and the CoE approved a similar modification (raising the pond 1 foot) applied for on February 6, 1995. You indicated that, as with the previous modification, the CoS did not considor the proposed modification to be a significant deviation from the existing permit, per conversation with Mark Giffin on February 22, 1996. The existing COE permit incorporates th State 401 Water Quality Cortification which was issued with no conditions on May 12, 1976. Because of the longth of timo that has passed since issued, we no longer have a copy of the certification letter, however the 401 Water Quality Certification for this project remains valid. Decause wetlands are likely to be created by raising the water levol, au proposed, mitigation should not be necessary for existing wetlands impacted by inundation. Therefore, the proposed modification will not contravene water quality standards nor chango classified uses of Lake Wylie and la consistent with tho oxisting 401 Water Quality Certification.
