SUBJECT:
CONSUMERS POWER COMPANY (MIDLAND)-ALLEGATIONS OF QUALITY ASSURANCE PROGRAMS AND HEATING, VENTILATION AND AIR-CM-D!TIONING CONTRACTOR'S QUESTIONABLE ACTIVITY REPORT NUMBER:
Q3-83-003 1.
On April 20, 1983, a review was completed of the allegations contained in 01 Inquiry File No. Q3-83-003, in reference to the Midland Nuclear Power Plant, Units 1 and 2, Midland, Michigan. The allegations that were specific enough in detail to warrant inquiry were of a technical nature and did not appear to fall within the realm or the Office of Investigation.

The original technical allegations were reviewed by Region III and resulted in Report No. 50-329/80-10; 50-330/80-11, Docket Nos. 50-329; 50-330 being issued. This inspection was conducted by Messrs. C.H. WEIL, R. F. COOK, C. E. J0NES, E. W. LEE, and H. H. LIVERM0RE of Region III during the period March 6 - July 31,1980, regarding Consumers Power Company's Ouality Assurance Program, as related to the heating, venti-lation and air conditioning contractor's activities at Midland Nuclear Power Plant, Units 1 and 2.

This inspection reviewed and looked into twenty-ore allegations (dealing with material traceability, violation of-procedurcs,-falsification of records, and the training of quality control inspectors) regarding the Zack Company work at the Midland construction site. Twelve of the twenty-one allegations were substantiated, and resulted in noncompliance with Title 10, Code of Federal Regulations, Part 50 (10 CFR' 50),
Appendix B, Criteria IV (Procurement Document Control), V (Construction, Procedures, and Drawings), VII (Control of Purchased Material. Equipment, and Services) -VIII (Identification and Control of Materials, Parts, and Components), IX (Control of Special Processes), X (Inspection),
XV (Nonconforming Materials, Parts, or Components), XVI (Corrective Action), XVII (Quality Assurance Records), and XVIII (Audits). The remaining nine allegations were not substantiated.

In March of 1983 further discussions were held between the members of Region III management, Regional Administrator, James G. Keppler; Deupty Regional Administrator, A. B. Davis; Regional Atty. S. Lewis; the Chief of Region III Projects Branch 2, W. D. Shafer; and the Director of the 01-Field Office, Region III, Eugene T. Pawlik, l
and it was mutually agreed that the allegations presented in Q3-83-003 also fell under the purview of Region III and were not OI issues.
