O MSC00 Sin Electnc rowta coursur 231 W. MICHIGAN, P.O. BOX 2046. MILWAUKEE, WI 53201 December 26, 1984 Mr. H. R. Denton, Director Office of Nuclear Reactor Regulation U. S. NUCLEAR REGULATORY COMMISSION Washington, D. C. 20555 Attention: Mr. J. R. Miller, Chief Operating Reactors, Branch 3 Gentlemen:

DOCKET NOS. 50-266 AND 50-301 REQUEST FOR CHANGE TO CONFIRMATORY ORDER OF JULY 12, 1983 POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 In your letter dated October 12, 1984 you suggested that our letters requesting modifications of dates contained in the Commission's July 12, 1983 Confirmatory Order should be pursued with a formal license amendments application. During a meeting between Wisconsin Electric representatives and Messrs. Colburn and Scinto of your staff, we voiced our disagreement with your request and enumerated our reasons for not submitting the requested license amendments application. We have subsequently learned that the Commissioners have recently ruled in another docket that confirmatory order conditions do not constitute license conditions. Accordingly, and as requested by Mr. Colburn, we are providing this letter to confirm the position discussed at the November 8 meeting that we believe a license amendments application in this matter is not necessary.

Very truly yours,
