FREEDOM OF INFORMATION ACT REQUEST i

This is a request filed pursuant go the Freedom of Infor-mation Act as amended ( 5 U.S.C. S 552 ).

The VYDA And VPIRG request a copy of all information held by the U.S. Nuclear Regulatory Commission or its regional offices concerning the discovery of,and subsequent invest-igation of, Cobalt-60 detected at several location around the grounds of Vermont Yankee during 1983,and the discovery, and subsequent investigation,of Cobalt-60 in material found on the grounds of the facility on February 2, 1984.

Our request includes,but is not limited to,all preliminary notifications of occurrences, Inspection and Enforcement Bulletins, notices, reports, letters or other correspond-ences, investigative data, third party submittals such have been provided to the NRC,or are available to the Commission, from Battelle Labs,the State of Vermont or anyone else,and all other information pertaining to Cobalt-60 related incidents in 1983 or 1984,or before,1f such earlier incidents are rele-vant to the later developments. We also ask for complete information concerning the connection of the Cobalt-60 waste material and inspections and de-contamination involving work at vermont Yankee,during the spring and early summer of 1983, on pipes for IGSCC in Vermont Yankee's primary pressure boundary region. We ask that the NRC also provide all relevant generic information concerning decontamination of pipes for UT testing for IGSCC in service sensitive plant regions, the kinds and composition of wastes generated and the volume of such wastes along with standards for the management of these materials.

We also request copies of all information produced or used by the NRC in determining the severity of violation decision on the February incident.

As you know, the amended Act provides that if some parts of a file are exempt from release that " reasonably segre-gable" portions shall be provided. Therefore,if some sections are exempt from release we request the remainder and ask that the legal basis for the particular exemption be pro-vided as well. We reserve the right to appeal any such de-cisions.

The amended Act permits the waiver of any costs associated with providing the requested information.5 U.S.C. l552 (a) (4) (A) allows that if "it is in the public interest because furnishing the information can be considered as primarily benefitiig the public." We respectfully request that costs and fees be waived in this case because this re-quest meets the public benefit test. The right of citizens to the information asked for herein,because of the importance of these matters to health and safety, public confidence in public institutions and industries and the fact that it will be shared with the public and made available by the petitioners.
