Docket Nos. 50-445 and 50-446 () C CASE's Fourth-Round Responses (to Applicants' Replies to CASE's Answers to Applicants' Motions for Summary Disposition)

During a telephone conference call among Judge Bloch, Applicants' counsel William Horin, and the writer on Monday, 11/12/84, I indicated that we would be filing in the next day or so our Motion for Reconsideration of the Board's 10/31/84 Memorandum (Multiple Filings).

I also stated that CASE did not want to have to respond to Appitcants' Third-Round Responses (to CASE's Answers to Applicants' Motions for Sunnary Disposition) until the Board had ruled on CASE's Motion for Reconsideration. We filed that Motion on 11/15/84.

We note that we have since that time received additional third-round responses by Applicants to other CASE Answers to Applicants' Motions for Sunnarv Disposition, i

and we would like to extend the same request regarding CASE's responses to those responses by Applicants (i.e., we do not want to have to respond to them until we have a ruling by the Board on our 11/15/84 Motion for Reconsideration, so that we will know how much and what we specifically have to respond).
