D.C. 20005 HEMOPJJ'DUM OF AGRECENT MIEREAS, the Nuc1 car Regulatory Cornission has under review an application for a construction permit for the proposed Jamesport Nucicar Pouer Station; and, MIEREAS, the Nucicar Regulatory Cernission, in consultation with the Mcv York State Historic Preservation Officer, has determined that this undertaking as proposed would have an adverse r>ffcet upon the llallock's Pond archeological site, Suffolk County, Scv York, a property determined by the Secterary of the Interior to bb cligtble for inclusicn in the National Register of' Historic Places; and, WHEREAS, the New York State Historic Preservation Officer has deterniced that this underteking as proposed would have an adverse cifect upon the Northville llistoric District, a property determined by the Eccretary of the Interior to be eligible for inclusion in the National Register of Historic Places; and,

'MIEREAS, pursuant.to Section 1(3) of Executive ordet 11593, the Nuclect Regulatory Cenission has requested the co=cnts of the V

i Advisory Council on Historic Preservation; and, MIEREAS, pursuant to the procedures of the Advisory Council on Historic Preservation (36 C.F.R. Part 800), representatives of the Advisory Council on llisteric Preservation, the Nuclear !!cculatory Con: mission, and the New York Historic Preservation Of ficer have con-sultcd and reviewed the undertaking to consider feasibic and prudent alternatives to avoid or satisfactorily mitigate the adverse effect;

now, TilEREFORE:

It is mutually agreed that impicnentation of the undertaking, in accordance with the stipulations contained in the attached letter i

of iby 10, 1976, from William H. Regan, Jr., Chief of Environmental Projects Branch 3, Divisien of Site Saf ety and Environmental Analysis, Nuclear Regulatory Cc=ission, will satisf actorily citigate any adverse effects on the above centioned properties.
