Dear Mr. Clements:
This letter references the letter of 'Sanford L. Hartman to you dated August 20, 1984.
In that letter.Mr. Hartman asserts that one of your employees " advised us that you would treat these documents as being filed today provided we advise you of their status and delivery date."
As I am sure you know, no such

procedure'is legal or authorized, particularly in a contested licensing hearing with a sitting Hearing Board which has issued an order requiring receipt of the documents by the parties by 5 :00 p.m.,
August 20th.
In. fact we not only did not receive the documents by 5:00 p.m.,
we did not receive any documents until 11:30 the following morning and as of 4:00 p.m.
today we still have not received all the required documents.
Obviously Mr. Hartman has misinterpreted whatever you intended to communicate to him.
Since this is a matter of substantial importance in these proceedings, I would appreciate it'if you would advise Mr. Hartman that he is in error and that documents are deemed filed for purposes of this case only in accordance with procedures established by the Board and that you will mark the documents received by you when they are received and your records will not reflect any other " constructive" filing dates.
Please also note that the Certificate of Service -filed by Mr. Hartman is in error and does not list our firm as the legal representative of CASE on the issue of harassment and intimidation.
