k.....,o SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO.172 TO FACILITY OPERATING LICENSE NO. DPR-46 NEBRASKA PUBLIC POWER DISTRICT COOPER NUCLEAR STATION DOCKET NO. 50-298

1.0 INTRODUCTION

By letter dated December 10, 1993, Nebraska Public Power District (the licensee) submitted a request for changes to the Cooper Nuclear Station (CNS),

Technical Specifications (TS). The requested changes would revise the reporting frequency of the Radioactive Materials Release Report and the Annual Design Change Report. This change reflects revised requirements contained in 10 CFR Part 50.

The Code of Federal Regulations, Title 10, Part 50 (10 CFR 50) was amended on August 31,1992 (57 FR 39353), to reduce the regulatory burden on licensees by revising certain reporting requirements.

Specifically, the regulations were revised to change the frequency of radiological effluent reports from twice per year to once per year (10 CFR 50.36a), and change the frequency for reporting changes at power reactors from once per year to once per refueling cycle (10 CFR 50.59(b)).

The licensee requested changes to the CNS TSs to reflect the amended regulations.

The licensee also proposed several editorial revisions to pages affected by this change.

2.0 EVALUATION The licensee proposed changes to the CNS TSs regarding the radioactive materials release report and the report on facility changes, tests and experiments to make the requirements consistent with the revised requirements of 10 CFR 50.36a and 10 CFR 50.59.

Throughout the CNS TSs the radioactive materials release report filed in accordance with 10 CFR 50.36a is presently referred to as either the

" Semiannual Radioactive Material Release Report" or the " Semiannual Radioactive Effluent Release Report." References to this report in the TSs listed below will be revised to indicate that the report is to be submitted annually, and for consistency the report will be referred to as the " Annual Radioactive Materials Release Report."

10. TS 6.6.2.A 11 TS 6.7.2.A The licensee proposed that TS 6.5.1.F.1 be revised to require that the Radioactive Materials Release Report'be filed annually instead of semi-annually.

In addition, the submittal date for the report would be revised from "within 60 days after January 1 and July 1" to "by May 1."

The footnote regarding verbal extension of this report submittal date would be deleted, as it is anticipated that with the revised submittal date this extension will no longer be required. The licensee also proposed that TS 6.5.1.F.2.c, regarding submittal of annual meteorological data as part of the Radioactive Materials Release Report be revised to be consistent with the new May I submittal date.

.The staff has reviewed these proposed changes and determined that they meet the requirements of 10 CFR 50.36a which became effective on October 1,1992 (57 FR 39353). The time of year or period of time permitted for submitting reports following the period of operation addressed by the report are not specified in 10 CFR 50.36a. The staff has previously endorsed a reporting time of within 90 days after January 1 of each year; however, it has subsequently been determined by the staff that this is unnecessarily restrictive. The May 1 submittal date provides adequate time for data collection and report preparation, consistent with current staff position, and is acceptable to the staff.

The licensee proposed revision of TS 6.5.1.C to change the submittal date for.

routine annual reports from March 1 to May 1.

These reports include:.1) personnel radiation exposure, 2) summary description of facility changes, tests or experiments (10 CFR 50.59 report), 3) radioactive source leak testing, and 4) safety or relief valve challenges. This change maintains consistency with the submittal date for the radioactive materials release report and is acceptable to the staff.

The licenses proposed a revision to TS 6.5.1.C.2 to permit the 10 CFR 50.59 report to be submitted with the Updated Safety Analysis Report (USAR) updates in lieu of annually. USAR updates may be submitted either annually or six months after each refueling outage in accordance with 10 CFR 50.71(e). This change is consistent with the requirements of 10 CFR 50.59 which became effective on October 1,1992 (57 FR 39353), and is acceptable to the staff.

The licensee also requested several editorial changes, consisting of capitalization of TS defined terms on the pages affected by this amendment request. This is an administrative change and is acceptable to the staff.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Nebraska State official was notified of the proposed issuance of the amendment. The State official had no comunent.

4.0 ENVIRONMENTAL CONSIDERATION

This amendment changes record keeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR Section 51.22(c)(10).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this amendment.

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
