In accordance with 10 CFR 50.4(b)(I), enclosed is Technical Specification Change Request (TSCR) No. 229. Also enclosed is a Certificate of Service for this request certifying service to the chief executive of the township and county in which the facility is located, as well as the designated oflicial of the State of New Jersey Bureau of Nuclear Engineering.

The purpose of this TSCR is to modify the requirements oflicensing condition 2.C.(5). This condition requires GPUN to perform an inspection of the core spray sparger and repair assemblics at each refueling outage. It further requires GPUN to submit the results of the inspection, provide an evaluation of the safety significance of any new or progressing indications and to obtain NRC authorization before the plant is restarted from the refueling outage.

GPU Nuclear, along with the entire industry, has shortened outages considerably and strives to continue that trend. This action will eliminate the administrative process associated with obtaining separate NRC approvals for reviewing inspection results and obtaining restart authorization prior to the end of each refueling outage. In addition, the phrase "once per 24 months" has been changed to "per refueling outage" In 1988 the NRC denied a similar aquest citing uncertainty in the loag term behavior of the repaired core spray sparger and to ensure that there is no further degradation in the system. The NRC concern about the propagation of existing cracks, and the initiation of new cracks should be alleviated by the positive results (no sparger indications)in each of the last six inspections i.e., the 1983,1986,1988,1991,1992 and 1994 inspections. 1 inspection a small leak was detected in the annulus piping which GPUN judged to be a weld defect and not a crack. The NRC Safety Evaluation Report (SER) issued February 5,1993 concluded that Oyster Creek could be safely operated without repairing the leak. The sparger inspections will continue to be performed in accordance with ASME B&PV Code,Section XI, 1988 Edition.

I Pursuant to 10 CFR 50.91(a)(1), enclosed is an analysis applying the standards in 10 CFR 50.92 to make a determination of no significant hazards consideration.
