1. I am employed by Carolina Power & Light Catpany ("CP&L") as the Project General Manager for the Harris Plant Construction Section.

I am responsible for construction activities at the Harris Plant. My business address is Shearon Harris Naclear Power Plant, Post Office Box 101, New Hill, North Carolina 27562. A statement of my background and qualifications is affixed hereto as Attachment A. I have personal knowledge of the matters stated herein and believe them to be true and

2. This affidavit is made in support of Applicants' Ntion for Sumnary Disposition of Eddleman Contention 45.

3. It is the purpose of this affidavit to confinn that applicants will verify prior to Fuel Ioad that the Harris Plant ECCS, Main Steam, and Feedwater Systems have been constructed in accordance with design docurents.
4. As stated in Paragraphs 5 through 13 of Mr. McCarthy's affidavit, the slope will be constructed in accordance with design specifications and verified prior to Fuel loading at SHNPP.
