The following is submitted in order to complete the referenced application, with a view that we may be licensed to possess physically, but not operate, the subject research reactor, under lease f rom the Cocannwealth of Pennsylvania, and that the Commonwealth of I'ennsylvania, acting th:ough the Department of Forests and Waters, be licensed as possessor of legal title to the reactor:

1) We wish to incorporate by reference the procedures and other relevant descriptive information contained in the applications to the existing license as they now apply, including but not limited to the Curtiss Wright Corporation Bazards Evaluation Report of April 1959, ao oended and supplemented to the utent applicable to our possession of the reactor in a shut-down condition.
2) As indicated in our letter of October 4,1967 the fuel elements which had at one time been in tbs pool, compricing the core identified in item b) 1) of the letter of September 29, 1960 from The Pennsylvania State University to the Connaission, have been removed.

They ' nave been returned to the Commission (Savannah River). The remaining fuel elements at the site, identified in item b) 2) of that letter (containing a maximum of 5.3 kilograms of uranium 235) are stored in the fuel storage vault at the facility. We assume that the f,

heense will cover this fuel as well as the related materials heretofore !'

_ 3) We have obtained financial protection from Nuclear Energy

-Liability Insu:ance Association and we have requested NELIA to for-ward evidence of this to the Commission. We accordingly request indemnification pursuant to section 170 of the Atomic Energy Act of 1954, as amended, covering our possession of the reactor in shut-down condition.

4) We request that the Cocuonwealth of Pennsylvania, acting through its Department of Forests and Waters, be recognized and licensed as possessor of title to the facility at the same time as we are licensed to possess it physically, but not to operate it.

The Commonwealth of Pennsylvania joins in this request, as evidenced by the countersignatures on its behalf below.

5) We request that, upon transfer of the 11conse to us. The Pennsylvania State University be appropriately notified and relieved from any further responsibility thereunder.

'Ihe Ccmnission has found that the transfer is in acccxtlance with the pro-visions of the Atcaric Energy /ct of 1954, as amended, ard has given its oansent pursuant to the provisions of Section 50.80 of 10 CFR Part 50.

Acconiingly, Anendment !b. 3 to Facility License No. R-72, copy enclosed, has been issued authorizing the Ccenormalth of Pennsyivania thmugh its Department of Forests and Waters to possess title to the facility, ard NUMEC to possess, but not to operate the facility.

With the issuance of this amendment The Pennsylvania State University's auth:rity as a licensee under this license is tersninated. The Order tenninating The Pennsylvania State University intenst in License No.

R-72 is enclosed.
