APPUCATION FOR AMENDMENTTO OPERATING LICENSE The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating Uconso DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.

This application for an amendment to the James A. FitzPatrick Technical Specifications allows performance of the inservice hydrostatic pressure and leak testing of the reactor vessol at temporatures excooding 212"F.

As the acctmutated noutron fluence on the reactor vessci incroacos, tho methodology used to calculate hydrostatic testing pressuro temperaturo limits will ultimately require that those test bo conducted above 212"F. The Technical Spocifications define hot shutdown modo as the condition when the reactor modo switch is in shutdown and reactor coolant temperaturo is abose 212 F. Applying this definition will requ!ro that hydrostatic tests be conducted while the plant is in hot shutdown. However, the current specifications require systems to be operable in the shutdown modo that can not be mado operable during the test (e.g., HPCI and RCIC steam lines will be filled with water). The proposed changos will allow hydrostatic testing of the Reactor Coolant System (RCS) above 212"F without requiring the HPCI, RCIC or ADS /SRW to be operable. All other systems required by technical specification will be maintained operablo during the test to protect public health and safety.

The proposed changes to the Technical Spocifications are Attachment I to this Application for Amendment to the Operating Uconso. The Safety Evaluation for the proposed changos is included as Attachment 11.
