APPLICATION FOR AMENDMENT ~C OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the Now York Power Authority, as holder of Facility Operating Uconso No. DPR 59, heroby applios for an Amendment to the Technical Specifications containod in Appendix A of this licenso.

This application for an amendment to the James A. FitzPatrick Technical Specifications addrossos throo associated issuos: Emergency Sorvico Water (ESW) pump survoillanco testing; incorporation of ASME Soction XI, and; editorial corrections.

ESW Pump Surveillanco Testing / Minimum Flowrato A surveillanco roquiromont for tho ESW system is added requiring ESW pumps to be flowrato tostod. During the August 21,1990 ESW onforcement conferenco the Authority identified tho limitations of tho ' shut off head' ESW pump survoillance test currently required by the FitzPatrick Technical Specifications and committod to proparo a Technical Spocification chango. The Authority clarified the commitment and stated that the now test requirements would ioflect tho appropriato portions of ASME Section XI and the FitzPatrick inservice test program. The proposed survoillanco requiromont includes a revisod pump flowrato to rofit.2 a now calculatinq of system requiromonts following a Dosign Basis Accident (DBA). This application satisfios that commitment, incorporation of ASME Soction XI This part of the amendment incorporatos tho inservico inspection and testing of Soction XI of the American Socloty of Mechanical Engincors (ASME) Boiler and Pressuro Vossol (B&PV)

Codo. It incorporatos a now Survollianco Roquiremont,4.0.E, which rotors to the requirements of Section XI of the ASME B&PV Codo and Addonda established by 10 CFR 50.55a(g).

Ancillary changes are also regulrod bocause the proposed Specification 4.0.E replaces survoillanco testing requirements on safety rotated pump and motor operated valvos and extends the frequoney of survoillanco testing on other components from onco ovory month, to onco ovory throo months to coincide with the Authority ASME Section XI program.

Editorial Corrections Minor changos such as typographical errors and corroctions aro also included in this submittal.

The proposed chango to the Technical Specifications is Attachmont I to this Application for Amendmont to tho Operating Uconse. Tho Safoty Evaluailon for the proposed chango is included as Attachment II.
