Dear Mr. Denton:
As previously discussed with members of your staff, Duke Power Company will
_be unable to comply with paragraph 2.C.(11)f.(3) of Facility Operating License No. NPF-9.
This license condition requires that certain portions of the incore thermocouple system outside containment be upgraded no later than l
December 31, 1983. Pursuant to paragraph 2.G of the License, Duke has notified the Regional Office concerning the inability to meet this license condition.
l Duke Power Company will submit a request by January 13, 1983 to amend the license condition to reflect an implementation date consistent with the schedules being identified as part of the response to NUREG-0737, Supplement 1.
In that these and other Control Room modifications will only provide incremental improvements in the reliability and human factors aspects of existing displays, it is not considered that the extended implementation date has any impact regarding the health and safety of the public.
