Dear Mr. Denton:

Attached are proposed license amendtr nts for Facility Operating Licenses NPF4 and NPF-17 for McGuire Units 1 and 2, respectively. These proposed 4

amendments would provide exceptions from the requirement for 8-hour battery-powered emergency lights for the Standby Shutdown Facility (SSF) and its access and egress routes through the yard area west of the Turbine Building.

Attachment 1 contains the proposed amendments. Attachment 2 discusses the justification and safety analysis. Pursuant to 10 CFR 50.91, Attachment 3 provides an analysis of whether the proposed amendments involve a significant hazards consideration. The proposed amendments have been reviewed and determined to have no safety or environmental impact.

Pursuant to 10 CFR 170.22, Duke Power proposes that this application contains one Class III license amendment and one Class I amendment. Accordingly, a check fur $4,400 is enclosed.

The licensee shall maintain in effect and fully implement all provisions of the approved fire protection plan and the NRC staff's McGuire Safety Evaluation Report Fire Protection Review in Supplement No. 2 to the McGuire Nuclear Station Safety Evaluation Report, dated March 1979. Duke Power Company shall comply with Sections III.G, Fire Protection of Safe Shutdown Capability, including Section III.L.

Alternative and Dedicated Shutdown Capability, as appropriate; III.J. Emergency Lighting (except for the Standby Shutdown Facility and the exterior access and egress route west of the Turbine Building); and III.0, 011 Collecticn System for Reactor Coolant Pump, of Appendix R to 10 CFR Part 50, dated November 19, 1980.Section III.G and III.0 shall be completed according to the following schedule (III.J having been completed).

Section 2.C. (7) . (a) Facility Operating License NPF-17 for McGuire Unit 2 is proposed to be amended to read as follows:

(a) The licensee shall fully implement and maintain in effect all provisions of the approved fire protection plan as amended in September 1982 and the Fire Protection Review in Supplement No. 5 to the McGuire Nuclear Station Safety Evaluation Report, dated March 1979. Prior to March 1, 1984, the licensee shall meet the technical requirements of Sections III.G. Fire Protection of Safe Shutdown Capability, including Section III.L. Alternative and Dedicated Shutdown Capability, as appropriate; III.J. Emergency Lighting (except for the Standby Shutdown Facility and the exterior access and egress route west of the Turbine Building); and III.0, Oil Collection System for Reactor Coolant Pump, of Appendix R to 10 CFR Part 50 and, shall complete to the satisfaction of the NRC all required fire protection items identified in Table 9.5-1 as revised in Supplement No. 6 and Appendix B of Supplement 5 j to the Safety Evaluation Report (NUREG-0422, February 1983 and April 1981).

IIRD/HBT/REH November 18, 1983 Attachment 2 Justification and Safety Analysis In an August 31, 1983 letter to J. P. O'Reilly, Duke Power reported deviation from the requirements of Facility Operating License No. NPF-9 for McGuire Unit I regarding emergency lighting for fire protection. The report stated that some areas in the plant do not have 8-hour battery-powered emergency lights where access is needed for operation of safe shutdown equipment.

License Condition 2.C.(4) of NPF-9 for McGuire Unit 1 requires lights in those areas (by referencing 10 CFR 50, Appendix R, Section III.J). License Condition 2.C. (7) of NPF-17 for McGuire Unit 2 also requires this prior to March 1, 1984. The aforementioned report also stated that emergency lights will be added by March 1, 1984 to comply with the license conditions. Subsequent review has revealed that additional emergency lights should not be required for the Standby Shutdown Facility (SSF) and the access / egress route through the yard to the SSF.

The'SSF is a structure completely separate from other structures which contain safe shutdown equipment. The SSF will be used to maintain the plant in a shutdown condition if a fire damages normal plant controls or safe shutdown equipment. Access to the SSF from the main control room would involve passing through the Turbine Building and the yard.

Eight-hour battery-powered emergency lights should not be required for the SSF and the yard area because the existing lights, including their power sources and cables, cannot be affected by a fire in any fire area which could require the use of the SSF. The yard lighting is powered from sources located in the Turbine Building and the cables do not enter the Auxiliary Building.

No fire in the Turbine Building would require using the SSF. The yard lights are also used for security purposes and are reliable.

The SSF contains AC lighting that is transferable to the SSF auxiliary diesel generator bus after the generator is started. In addition, the SSF contains 90 minute battery-powered emergency lights which actuate upon loss of AC power.

Ninety minutes is more than enough time to manually transfer the AC lighting to the diesel generator bus. A fire in the SSF would not affect normal safe shutdown equipment and, therefore, would not require the use of the SSF.

IIRD/IIBT/REH November 18, 1983 Attachment 3 Analysis of Significant llazards Consideration This analysia is provided pursuant to 10 CFR 50.91 concerning whether the proposed amendments would involve the consideration of a significant hazard, as defined by 10 CFR 50.92.

The proposed amendments would allow operation of the facilities without 8-hour battery-powered emergency lights provided in the Standby Shutdown Facility (SSF) and in the access and egress routes th;ough the yard area west of the Turbine Building. Implicit in the requirement for the 8-hour battery-powered emergency lights -- despite other AC and DC emergency lights in the areas containing safe shutdown equipment --is the assumption that a fire could simultaneously disable the existing emergency lights and safe shutdown equipment. A fire in the SSF, in the yard, or in the Turbine Building would not damage safe shutdown equipment such that the SSF would be required to maintain safe shutdown. Furthermore, as sheyn in Attachment 2, a fire in any other area would not disable the existing emergency lights. Therefore, adequate lighting would be available for any fire event requiring the SSF to be used without installing additional 8-hour battery-powered emergency lights. Based upon the above, the proposed amendments would not involve any increase in the consequences of an accident previously evaluated nor any reduction in a safety margin.

Because emergency lights serve only to mitigate accidente, the proposed amendments do not involve an increase in the probability of an accident nor do they create l the possibility of a new or different kind of accident. Based upon the above analysis, Duke Power proposes that the proposed amendments do not involve a significant hazards consideration.
