In the Matter of Application of Texas Utilities Generating Company, et al. for An Operating License for Comanche Peak Steam Electric Station Units #1 and #2 (CPSES)

Docket Nos. 50-445 and 50-445 Introduction into Evidence of f1RC Inspection and Investigation Reports As you will recall, on April 18, 1983, I inquired as to whether or not the flRC Staff would be requesting that the full CAT report wr geig M be moved into evidence by the Staff.

As we explained at that time, there are some specific Inspection and Investi-gation Reports done recently by the flRC regarding Comanche Peak which we may wish to get into the record (which included the CAT report specifically).

It was my understanding at that time that the Staff did not know whether they would ask that any of these reports be admitted into evidence. As I explained during that conversation, we are especially anxious to avoid a repeat of the problem we ran into in the June hearings, where the Staff had stated that it l did not intend to introduce into evidence any of their I&E Reports; therefore, I

CASE spent some $5,000 or so making copies of them to introduce into evidence, and when the Staff saw that we were asking that they be introduced, the Staff introduced their own copies and the Board accepted the Staff's and CASE's had to be withdrawn. (See discussion on pages 36-38 of CASE's 12/21/82 Brief in Opposition to the f1RC Staff's Exceptions to the Atomic Safety and Licensing Board's Order Denying Reconsideration of September 30,1982.)

We would appreciate your letting us know right away whether or not there are any such reports which the Staff plans to ask be admitted into evidence, so that we can make whatever arrangements are necessary to see that they are ad-mi tted into evidence. If it would be helpful, we can supply the Staff with particular I&E Report numbers.
