UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION 00gETED gC BEFORE THE ATOMIC SAFETY AND LICENSING BOARD . ..

'83 SEP 26 M1:05 0FFICE OF SECF.ti.W-DUKEPOWERCOMPANY,et_.al. DocketNos.SNEY$kCk S 50-414 (Catawba Nuclear Station, Units 1 and 2)

APPLICANTS' OBJECTIONS TO PREHEARING CONFERENCE ORDER On September 14, 1983 the Board issued a Prehearing Conference Order. Therein it provided (at p.9) that any party may file objections to this Order by September 23, 1983. Applicants herein note their objection (or comment) to one item.

In its discussion of the Order of Presentation the Board noted at p.3 that "a comparatively brief opportunity for rebuttal by the party making the first presentation may be allowed

, primarily in order to address unanticipated matters arising during cross-examination."

With respect to Contention 44/18 the Board ruled that Applicants would go second. However, inasmuch as Applicants are the party with the burden of proof, they request an opportunity, if necessary, to l provide rebuttal testimony on this matter.

Respectfully subm' ted, Albert V. C r Jr.
