Dear Mr. Keppler:
Pursuant to my conversation yesterday, August 10th, 1983, with your Mr. James Konklin (312-932-2500), we wish to file a report of Non-Conformance under Federal Regulation 10 CFR Part 21 and outlined as follows:
1.)
Energy Steel & Supply Co. is the informant to the NRC under the signature of the writer.
2.)
The material in question of 8-pieces W 10 X 33 X 20-0 beams which are to be used for a critical Safety Related NF Support in a Containment Building.
This is the only location that we supplied the beams in question to.
3.)
The material in question has been sold to Johnson Controls, Inc. through a contract with United Engineers & Constructors, Inc. at the Seabrook Power Station, Seabrook, New Hangshire.

The material in question as determined by Johnson Controls, Inc. is out of web tolerance (See enclosure).
5.)
We were informed of the defect by Johnson Controls, Inc. on June 2, 1983.
The NCR was officially submitted to us by Johnson Controls, Inc. under their NCR #SR-888 dated June 8, O
1983, and received by Energy Steel & Supply Co. on June 20,

On Monday, August 10, 1983, a meeting was held in Seabrook at our request between Johncon Controls, Inc., United Engineers
& Constructors, Inc., and Energy Steel & Supply Co. in an ef-fort to examine and resolve this matter.
It was explained by Energy Steel & Supply Co. that the material being rojected was purchased from ITT Grinnell, Chicago, IL who in turn purchased the indterial from Inland Steel Co., Chicago, IL.
Energy Steel & Supply Co. explained that it had notified ITT Grin-nell on June 3rd, 1983, of the rejection.
ITT said they would take the problem up with U.S.
Steel Supply Co. who in turn would notify Inland Steel Co.
In the time period from June 3, 1983, through August 3, 1983, Ener-gy Steel had made numerous calls to ITT Grinnell in an effort to resolve this rejection with virtually no response.
Energy Steel & Supply Co. received a call on Friday, July 22nd, from Inland Steel Co. informing us that they felt their product was fully within the specified mill tolerances for that section.
En-orgy Steel explained that we understood their position, however, in reviewing the specifications of ASTM A-6 Johnson Controls, Inc. in-sisted that this-material was non-conforming and out of tolerance and therefore was rejecting it.
In our meeting at Seabrook, United Engineers & Constructors, Inc.
also took the position of Johnson Controls, Inc. and said the ma-terial was rejectable even though they personally did not inspact the material in question.
It was further. stated that although both United Engineers and Con-structors, Inc. and Johnson Controls, Inc. purchace and receive ma-terial'to the same specifications that United Engi..eers & Const-ructors and Johnson Controls perform two different 2.eceiving in-spections.
7.)
Energy Steel & Supply Co. feels that it has respond (d re-sponsibly in every way in an effort to resolve this non-conformance.
It is clearly. stated however,,that.the material supplier (Energy Steel);is not responsible for dimensional conformance, but in fact that responsibility of the Material Manufacturer to assure con-formanca to the material' specifications.

Energy Steel & Supply Co. is in agreement that Inland Steel Co. is correct in their determination based upon the fact that Energy Steel has personally inspected the non-conforming beams.
It was suggested by Energy Steel to both ITT Grinnell and In-land Steel that Inland Steel attend the meeting scheduled for August 8, 1983.
Inland Steel declined to attend and in ad-dition has refused to send a mill representative to the job site to determine in fact whether the beams in question are in conformance or non-conformance to the material specification.

Please be advised that Energy Steel & Supply Co. has filed with the Nuclear Regulatory Commission (NRC) today a report concerning our above order and our NCR #0027 under the I.*m41sions Federal Regulation 10 CFR Part 21 Upon conclusion of our meeting Monday between Johnson Controls, Inc.,
and United Engineers & Constructors, Inc., it was determined by both parties that this material was to be used for a Critical Safety Related NF Support and that the web tolerances are out of mill tolerance on 8-pieces and unacceptable.

lie indicated that material must meet weight per foot and cross sectional area. We should check all thickness, throughout flange and see if weight and flange thickness would meet specification require-ments.
Mill will mic flanges and web every foot to see if the sectional area comes to within 2.5% of entirety.
Called Leo Bourgoin and he indicated that he has checked the flanges all the way down, flanges, web, length and width and cannot come to that 2.5%.
Again reported to ITT that a claim should be begun and that we would appreciate discussing this matter with the mill as soon as possible as we will need replacement material.
They will put in writing once they receive our written nonconformance.

In response to my final conversation today with Mr. Dan Zienty con-corning the above NCR, I wish to issue as a matter of record the fol-lowing statement.
The material in question was purchased from:
ITT Grinnell Corp.
4425 S. Western Ave.
Chicago, IL 60609 Upon being notified of this rejection I notified Mr. Daniel Zienty of ITT.
He said he would follow through on complaint.
A copy of our NCR was forwarded to ITT upon receipt of NCR #SR-888 from Johnson Controls.
I was then informed by ITT that they purchased material from U.S. Steel Supply Co. who in turn had purchased material from Inland Steel Co.
On Friday, July 22nd, I received a call from Mr. Brian Bozek, Staff Assistant, Structural Division from Inland Steel Co. (312-346-0300).
Mr. Bozek informed me that Inland wo' tic' not honor any claim for the reasons indicated as Inlands position was that the claim was rediculous.
I proceeded to go through the ASTM Standards and ASME Specifications with Mr. Bozek to fully describe thq, tables, tolerances, etc.
He then said he would check further into the matter and call me back on Monday morning, July 25, 1983.
I also advised him that we had a preliminary meeting scheduled at Seabrook and that I would suggest participation from someone at Inland Steel.
I finally talked to another individual at ITT and was told that Mr. Otto and Mr. Zienty were not in, but I should contact a Mr. Marty Majorsan, salesman at U.S. Steel Supply.
Mr. Majorsan said he was familiar with l
the problem but that I should contact a Mr. John Shad instead.
I asked
- to be transferred and he said Mr. Shad was on the phone and that I l
should call back.-
I suggested Mr. Shad should call me back as that I had to have answers now.

ITT would not return my calls.
I advised Mr. Daigneault of Johnson Controls that I was doing everything within my ability to get a determination from ITT, but was unable to respond because they would not return my calls.
Repeated calls were made to Mr. Herb Otto and Mr. Dan Zienty of ITT to determine status of rejection so that non-conformance could be resolved.
They would not return my calls.
I informed their secretary that I would notify the ASME and also advise the NCR under the provisions of 10 CFR 21 if there was no further response.
I was contacted today by Mr. Zienty who said Inland Steel was mailing a response to U.S. Steel Supply who in turn would forward a copy'to ITT who in turn would forward a copy to Energy Steel & Supply Co.
He also said Mr. Bozek denied over talking to me.
I was advised that the contents of Inland's letter would be that they would not accept the rejection as the material was within dimensional,
,.hysical and chemical conformance to the section and that they would not se interested in participating in any meeting with United Engineers, Johnson Controls or Energy Steel & Supply.
This memo is to be pended until Tuesday, August 5th.

In attendance were:

- 1) Mr. Steve Ostrowski Project Manager
- 2) Mr. Tim Diagneault Buyer
- 3) Mr. Leo Bergoin OC-Receiving Engineer The above individuals represented Johnson Control's, Inc.
The meeting, lasted approximately one hour and in conclusion, Johnson Controls still insisted that the material was not within Mill tolerances, could not be down graded and therefore was non-conforming and rejected.

Wo. explained our position of being a Material Supplier and were not-responsible for dimensional conformances and that Inland Steel Co. who was asked to send a representative to this meeting declined and proposed to do nothing to resolve this non-conformance.
I further explained that if we could not agree on a resolution to correct this problem I would have no alternative, but to file a Non-Conformance Report with the NRC under the provisions of 10 CFR Part 21.
It was agreed that since we could not get either ITT Grinnell or Inland Steel Co. to respond that we were compelled.to file with the NRC.
After the meeting I personally inspected the 8-pcs of W 10 x 33 beams and now agree with Inland Steel's initial comment that this claim was ridiclous.
It is my strongest belief that if this material is in fact non-conforming and being rejected for the reason stated, that 80%
of all the steel on site and installed in place would be rejected and have to be removed and replaced.
I have advised ITT Grinnell today of our intension to file a Non-Conformance Report with the NRC.

Your Order: EC3144548 Our Orders Y 89527 Inland Wide Flange Shapes A36-81a W 10 x 33.0# x 40' It is our understanding that eight pieces out of ten pieces shipped were checked at a job site and web thickness measured between 0.252" and 0.270".
As explained by our Mr. O'Keefe, the web thickness of 0.290" identified with this size is only a theoretical value which can vary within reasonable limits. Although the dimensions of a section are variable, we do produce to a foot weight as designated for that section.
In this case that you are presenting, the other dimensions of the cross section are equally important in evaluating conformance.
The inspector should nake such measurements before asking a judgment on the suitability of application.
