This will acknowledge our telephone conference of last Wednesday wherein we discussed several matters relating to the pending discovery between Applicants and Palmetto Alliance.
The following constitutes additional information in accordance with our conversation with respect to certain of Palmetto Alliance's Follow-up Interrogatories, as well as certain of your initial Interrogatcries which we have previously discussed.
Contentien 6 (Follow-up Interrogatory 7)
In addition to those NRC Inspection Reports identified at p. 21 of our March 25 Responses to your Follow-up Interrogatories, Inspection Report Nos. 50-413/80-29; 50-414/80-29 deal with, among other things, a complaint made to the NRC. As explained in our March 25 Response, and as we discussed, we have no information beyond that contained in the referenced Inspection Report, and we do not know of any further incidents which are responsive to your request.

(Follow-up Interrogatory 9) As we discussed, the documents responsive to this Interrogatory were available for inspection and copying on March 30; however, the identification was not then complete. At your request, last Thursday we sent to you by Federal Express (at Palmetto Alliance's Columbia l
address), the documents responsive to this Interrogatory.
Identification of these documents has been completed, and is Attachment 1 to this letter.
We also have in our possession, and have reviewed, the files of Gail Addis, Employee Relations, Duke Power Company. These files contain, among other things, notes taken by Ms. Addis during her interviews with inspectors at the initial' stages of the recourse procedures.
It appears to us that the technical concerns expressed in those notes, as well as other documents in the files, are reflected in the materials which have already been provided to you or made available in response to Interrogatories 23 and 25. Nevertheless, these documents are in our offices and, should you wish to inspect them, will be made available to you.

In an earlier conversation (on March 9 or 10) you had raised questions with regard to our response of February 28, 1983 to those Interrogatories.
In accordance with our discussions, we agreed to broaden our search for documents responsive to your request. That was done, and the widened search has recently been completed.
It included, among other things, our meetings with QA employees at Catawba. As we discussed, the documents were available for inspection March 30. However, the identification of those documents has only recently been completed. That identification is Attachments 2, 3 and 4 to this letter.
On March 14, 1983, you requested a copy of an Exit Interview for former employee Marvin Johnron (referenced at p. 35 of our February 28 Supplemental Responses).

We discussed a number of matters relating to'this Interrogatory and our March i
25 Response.
I 1.
Pre-employment tests You asked to see the pre-employment tests as well as the test scores for Catawba eperators. The test scores, appropriately coded, have been available for inspection since March 30.
So far as the pre-employment tests themselves are concerned, it is necessary that they be kept confidential, since to disclose them might compromise their validity. Therefore, copies of these pre-employment tests will be made available for your inspection, but only after execution of an appropriate affidavit of nondisclosure.

Psychological Tests l
Copies of the tests and scores, appropriately coded, have been available for inspection and copying since March 30, 1983.
3.
Interviews You had asked a question concerning the " Applicants' Appraisal Form."
Though such form is a part of the hiring process, it is not a " test used or to be used in qualifying reactor operation applicants at Catawba." Thus, such a form, completed following an interview of a prospective employee, does not fall within the scope of your Interrogatory. Nevertheless, we will under-take to make these forms available, assuming that they exist as a part of the employee's personnel file, for inspection. The forms will be appropriately coded to protect the privacy of the individual involved.

Physical Examinations Copies of Applicants' and NRC's physical examinations have been available for inspection since March 30, 1983.
5.
Cold License Certification The full sequence of tests and test scores, appropriately coded, have been available for inspection and copying since March 30, 1983.
You also inquired about the tests and quizzes administered following individual blocks of instruction, to candidates for reactor operator licenses as they move through Applicants' training program. Ycu wanted to know if you could see a representative set of such tests or quizzes. As I stated, assuming that a representative sample can be gathered, it may be that we must ask that they be held confidential, as tc disclose these tests and quizzes would compromise their validity.
I do not yet have answers to these questions, and will have to get back to you on d.is matter.
Contention 16 (Follow-up Interrogatory 5)
You asked a cuestion regarding our respense to this Interrogatory. As stated, we are not tware of any instance in which boron concentrations have fallen below 2,000 ppm in the spent fuel cooling system at any Duke operating facility. Your contention is, of course, concerned only with the spent fuel pool at Catawba, and thus the answer was properly limited. Nevertheless, there was an incident at Oconee in which the boron concentration fell below 2,000 part per million in the reactor coolant system.
This matter was reported in Reportable Occurrence Report 270/80-3, dated June 5, 1980. This Report has been available for inspection and copying since February 15, 1983.
Contention 27 (Follow-up Interrogatory 2) You asked for a reference to the Station Technical Specifications for the radiation monitoring redundance requirements, as well as information regarding the status of the draft Technical Specifications.
I am informed that the draft Technical Specifications are scheduled to be submitted to the NRC on May 1.
The instant requirements will be in Technical Specifications 3.3.3.8 and 3.3.3.9.
(Follow-up Interrogatory 4) The reference you requested is contained in Section I.11 of the Catawba Emergency Plan, not the Crisis Management Plan, as originally stated. The earlier answer was in error.

It is entitled " Surveillance Capsule Results From Oconee Nuclear Station, Units 1, 2 and 3" and is a paper presented at a conference in October of 1977. You had requested a copy of this document.
In checking my records, I learned that it was not sent,to you last Thursday.
I am therefore enclosing another copy with this letter.
I realize, of course, that there is still pending before the Board the objections which we posed to certain of your Follow-up Interrogatories.
However, leaving that aside, I believe that Applicants, with the single exception noted above (relating to tests and quizzes administered to candidates for reactor operator licenses during Applicants' training program),
have complied fully with all Palmetto Alliance's discovery requests. To summarize briefly, on September 22, 1983, Applicants filed their responses to Palmetto Alliance's Interrogatories on Contentions 8 and 27; documents i
identified in those responses have been available for inspection and copying since October 4, 1982.
On October 19, 1982, Applicants responded to Primetto Alliance's Interrogatories on Contention 16. Documents identified in those responses have been availeble for inspection and copying since November 1, 1982. On December 31, 1982, Applicants responded to Palmetto Alliance's Interrogatories on Contentions 6 and 7; the documents identified in these responses have been available since February 15, 1983.
Following the Board's Order of February 9 on your Motion to Compel, Applicants previded i

The decision to reduce the Welding inspector grade by one level is discussed along with the communications / steps taken by QA management to implement this decrease and grade.
The second part of this memorandum documents the instructions concerning the task force appointed as a result of W S Lee's letter of December 4, 1981.
