APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the Regulations of the Nuclear Regulatory Commission, i Niagara Mohawk Power Corporation, holder of Facility Operating License No. NPF-69, hereby requests that Specifications 4.7.1.1.1.d.4 & 5 and 4.7.1.2.1.d.4 & 5 of the Technical Specifications set forth in Appendix A to the License be amended. These proposed changes have been reviewed in accordance with Section 6.5 of the Technical Specifications. ,

The proposed Technical Specification changes contained herein represent revisions to Surveillance Requirements 4.7.1.1.1.d.4 & 5 and 4.7.1.2.1.d.4 & 5 regarding the operability testing of the service water pumps and resistance testing of the intake deicing heater system. The proposed changes remove the requirement to perform these tests l' during shutdown and would permit these tests to be performed during' any operational condition. The proposed changes will not authorize any change in the types of effluents or ,

in the authorized power level of the facility. Supporting information and analyses which demonstrate that the proposed changes involve no significant hazards considerations  !

Pursuant to 10CFR50.91 (a)(5), Niagara Mohawk requests that this Application be considered an emergency situation and that the NRC issue the requested license .

Attachment D presents the environmental considerations for the proposed Technical 1 Specification changes and concludes that no environmental impact statement or environmental assessment need be prepared.

WHEREFORE, applicant respectfully requests that Appendix A to Facility Operating License l No. NPF-69 be amended in the form attached hereto as Attachment A. j i
