On August 30,1994, following discussions with the NRC Staff, enforcement discretion was i

verbally granted to provide relief from the requirements of Limiting Condition for Operation (LCO) 3.0.3 and Action f for LCO 3.7.1.1. Relief was required to prevent shutdown of the plant because Surveillance Requirements 4.7.1.1.1.d.4 & 5 and 4.7.1.2.1.d.4 & 5 had not been performed durine shutdown. However, these surveillances have been performed withm l

the past 18 months as required by the Technical Specifications. On August 31,1994, i

Niagara Mohawk Power Corporation submitted a letter (NMP2L 1493) documenting its request for the enforcement discretion. As previously discussed with the Staff, it is Niagara l

Mohawk's intention to continue operation in this manner until the next shutdown or until an emergency Technical Specification change is granted. Changes to Technical Specifications 1

3/4.7.1.1 and 3/4.7.1.2 are required to terminate the need for enforcement discretion.

l Therefore, Niagara Mohawk hereby transmits an Application for Amendment to the Nine Mile Point Unit 2 Operating License NPF-69. Also enclosed in Attachment A are the proposed changes to the Technical Specifications set forth in Appendix A to the above mentioned license. Supporting information and analyses demonstrating that the proposed i

changes involve no significant hazards consideration pursuant to 10CFR50.92 are included as Attachment B. Niagara Mohawk requests this Application for Amendment be considered as an emergency situation as defined in 10CFR50.91. Information contained in Attachment C demonstrates that criteria contained in 10CFR50.91 (a)(5) for issuance of the license amendment without prior notice and opportunity for a hearing or public comment are met.

Attachment D presents the environmental considerations for the proposed Technical Specification changes and concludes that no environmental impact statement or environmental l

assessment need be prepared.

The proposed Technical Specification changes contained herein represent revisions to Surveillance Requirements 4.7.1.1.1.d.4 & 5 and 4.7.1.2.1.d.4 & 5 regarding the 18 month operability test of the service water pumps and the resistance test of the intake deicing heater system. The proposed changes remove the requirements to perform these tests at shutdown and would permit these tests to be performed during any operational condition.

Page 2 This amendment does not address the concerns raised during the NRC service water system operational performance inspection (50-410/93-80). A future amendment will be submitted to resolve these concerns.

Pursuant to 10CFR50.91 (b)(1), Niagara Mohawk is providing a copy of this license amendment request and the associated analyses regarding no significant hazards consideration to the appropriate state representative by overnight messenger.
