TVA'does not now consider the subject nonconforming condition adverse to the safe operation of the plant. Therefore, we will amend our records to" delete.the subject nonconformance as a 10 CFR 50.55(e) item.

Description of Deficiency The following 20" valves are identified as Seismic Category I (active) by design criteria documents. They were inadvertently specified and purchased as Seismic Category I(L) (i.e., limited seismic requirements).

The Borg-Warner valves are motor-operated gate valves, and the Atwood and Morrill valves are swing check type.

Safety Implications TVA has been able to upgrade the seismic category of the subject valves from I(L) to I(active) as required. This upgrading was based on qualification reports received from the vendors and approved by TVA.- Therefore, had.this condition remained uncorrected, it could not have adversely affected the safety of operations of the plant. Consequently, TVA no longer considers this item reportable under the provisions of 10 CFR SC.55(e)
