SUMMARY
OF THE REACTOR OVERSIGHT PROCESS MONTHLY PUBLIC MEETING HELD ON FEBRUARY 26, 2020 On February 26, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public teleconference with the Nuclear Energy Institutes (NEIs) Reactor Oversight Process (ROP)
Task Force executives, and other senior industry executives, to discuss the staffs progress on the ROP initiatives. The topics discussed during this teleconference are described below.
Significance Determination Process Revisions to Inspection Manual Chapter (IMC) 0609 The NRC staff provided an update on a planned revision to IMC 0609, Significance Determination Process, dated October 23, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18187A187). The scope of the changes was described during the teleconference and documented under ADAMS Accession No. ML20054B668. The staff plans to issue the revised guidance with an effective date of April 30, 2020.
It is not anticipated that a revision to IMC 0308, Attachment 3, Significance Determination Process Technical Basis, dated June 16, 2016 (ADAMS Accession No. ML15268A268) is necessary to support the minor revisions to IMC 0609. The Very Low Safety Significance Issue Resolution process, as described in IMC 0612, Appendix B, Additional Issue Screening Guidance, dated December 12, 2019 (ADAMS Accession No. ML19247C384) is independent from the Significance Determination Process (SDP) color scheme. Maintaining clarity that inspection findings and their corresponding significance as determined by the SDP are inputs to the assessment process is described in IMC 0308, Attachment 3, Section 02.06.

NEI expressed a concern that basis documents should be revised in parallel to the corresponding program document. The NRC staff indicated that for minor program revisions that do not fundamentally impact the basis, a revision to the basis document may not be necessary. The staff will continue to evaluate the need to revise the program basis documents consistent with IMC 0040, Preparing, Revising, and Issuing Document for the NRC Inspection Manual, dated January 5, 2018 (ADAMS Accession No. ML18003A122).
Revisions to IMC 0609, Appendices C and D The NRC staff provide the status on the effort to update the Occupational Radiation Safety (ORS) and Public Radiation Safety (PRS) significance determination processes (SDP) and corresponding bases documents (4 documents in total). The ORS SDP and basis documents will be updated to address administrative issues and to make minor additions to guidance content. The PRS SDP and basis documents will be updated to modify regulatory references and to add methodologies for dispositioning transportation-related findings where incorrect packaging is involved, including 10 CFR Part 37 findings. The PRS documents will also be updated to conform with current NRC organizational descriptions and references. The NRC staff stated that these documents will be available for review in May 2020 and that the NRC will host a follow-on public meeting to discuss the updates in the May/June 2020 timeframe. The staff developed a briefing sheet on this topic to support this teleconference (ADAMS Accession No. ML20052D178).
Revisions to IMC 0609, Appendix H The NRC staff provided status on the efforts to update the procedure for IMC 0609, Appendix H, Containment Integrity Significance Determination Process (ADMAS Accession No. ML20050T442). This procedure is being updated to address the AP1000 reactor design. The staff expect that the procedure will be issued by April 2020. The accompanying basis document, IMC 0308, Attachment 3, Appendix H, Technical Basis for Containment Integrity Significance Determination Process, is projected to be updated by December 2020.
NEI Response to IMC 0609, Appendix G External stakeholders were provided with an opportunity to ask questions regarding the recent revision to IMC 0609, Appendix G, Shutdown Operations Significance Determination Process.
However, no specific questions were asked during the teleconference. The NRC staff informed the industry that they intend to host a Shutdown Workshop on April 23, 2020, at NRC headquarters, and more information, including a public meeting notice would be published within the next few weeks.
Action: NEI requested that the upcoming Shutdown Workshop include a timeslot dedicated to probabilistic risk assessment as it relates to IMC 0609, Appendix G. If such topic is added to the Shutdown Workshop agenda, NEI committed to providing questions on the topic prior to the workshop.
ROP Updates Cross Cutting Issues (CCI) and Problem Identification and Resolution (PI&R)
Although CCI and PI&R were listed as agenda topics for this teleconference, the NRC staff indicated that there were no updates available for these two topics and the staff hopes to provide updates at a future ROP meeting.
Independent Spent Fuel Storage Installation (ISFSI)
The NRC staff provided an update on the overall status of the proposed ISFSI inspection program recommendations. The staff discussed the status of the internal review of the draft final recommendations report which is expected to be publicly available in early March 2020. The staff also discussed an upcoming public meeting and presentation at the Regulatory Information Conference (RIC) on March 9th and 10th respectively to discuss the draft final recommendations report (NRCs RIC was subsequently cancelled). The NRC staff presented the timeline for the activities that will follow the public meetings including issuance of a final decision on the recommendations expected by the end of March 2020.
Request for Feedback on the Updates to the ROP Website The NRC staff requested that if anyone from the nuclear industry or a member of the public has comments at it relates to the updates of the ROP website, to please provide those comments via the contact us tab on the webpage. The link for the contact us tab is provided below.
Engineering Inspection Updates The NRC staff completed its first power-operated valve (POV) basic assurance inspection at the Cooper Nuclear Station. The staff indicated that the inspection was a success and that the staff will use a cross regional panel to review the potential findings that were identified for the Cooper site. The staff expects to have the results from the cross-regional panel within 45-days after the inspection. A member from the nuclear industry asked the NRC staff if they felt that the initial request of 30 POVs was a sufficient sample set. The staff responded that they felt the sample set is currently sufficient but will consider the sample size as more inspections are completed.
A member of the public also asked when will the NRC staff be able to provide lessons-learned from the POV inspections. The NRC staff stated that they would like to complete an inspection in each region and will possibly be ready to share insights from the POV inspections during a public meeting in late Summer 2020. An industry representative stated that they are encouraged by NRCs transparency and willingness to engage the industry as these inspections are completed.
Performance Indicator Frequency Asked Question (FAQ) 20-01 The NRC staff indicated that they needed additional time to review and prepare a proposed draft response to FAQ 20-01. The staff will be prepared to discuss this item at the next ROP meeting.
Communicating with the NRC staff At the start of all ROP public meetings, the project manager provides contact information for the public to use to provide their name as a participant in the meeting. This contact information is
also provided for submitting questions and comments to the NRC technical staff. Please note that any questions and/or comments pertaining to the ROP project can be sent to Tekia.Govan@nrc.gov or Russell.Gibbs@nrc.gov. Questions and/or comments will be forward to the appropriate NRC staff. The staff also mentioned the role out of the Contact Us about ROP page on the new ROP website, which can also be used to submit questions and comments regarding the ROP initiative (https://www.nrc.gov/reactors/operating/oversight/contactus.html).
Conclusion At the end of the teleconference, NRC and industry management gave closing remarks. NEI expressed appreciation for the open dialogue and willingness of NRC staff to hear industry views, even in areas where NRC staff and industry may not be aligned. The NRC management stressed the importance of NRC being focused on providing reasonable assurance of public health and safety when considering changes to the ROP.
