SUMMARY

OF THE JANUARY 30, 2020, CATEGORY 1, PUBLIC MEETING TO DISCUSS NUSCALE POWER, LLCS REGULATORY ENGAGEMENT PLAN FOR THE SUBMITTAL OF A STANDARD DESIGN APPROVAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC) held a Category 1 public meeting on January 30, 2020, to discuss the NuScale Small Modula Reactor Standard Design Approval (SDA) Regulatory Engagement Plan (REP) intended to guide interactions between NuScale and the NRC for the planned submittal of the SDA application. The plan identifies the planned regulatory approach and defines interactions and roles and responsibilities in order to enhance communication and reduce regulatory uncertainty. Members of the general public participated via Bridgeline during the meeting.

The public meeting notice dated January 30, 2020, was posted on the NRC public Web site and can be found in the NRCs Agencywide Documents Access and Management Systems (ADAMS) under Accession No. ML20029C605. The REP identifies the planned regulatory approach and defines interactions and roles and responsibilities in order to enhance communication and reduce regulatory uncertainty.

A. Outcomes:

1. The NRC staff stated that NuScales REP submitted on the docket is a good source of information for resource planning purposes; however, the staff does not review and approve applicants plan for future application submittal.
2. NuScale presented a table that summarized and compared the contents of a Combined License (COL) Application, a Design Certification Application (DCA), and an SDA application that is required by the regulation. In addition, they included the contents of an SDA application that they considered is needed to support a COL application and the contents of their planned SDA application.
3. It was noted that the NuScale planned SDA application will contain ITAAC (inspections, tests, analyses, and acceptance criteria) and technical specifications in addition to what is required by the NRC regulation for an SDA application. The staff did not see an issue with an application that contains information beyond what is specifically called out in the regulation as long as it is applicable to the major portion of the standard design for which NRC staff approval is sought. The staff also noted that final determination on the acceptability of the content of the application cannot be made until the application is submitted and a formal acceptance review is performed.
4. At the conclusion of the meeting, NRC staff opened up the meeting to questions from the general public. A member of the public asked question regarding the connection between the ongoing DCA review and the planned SDA application and what would be used in future COL application. The staff provided information to the callers satisfaction.
