STIPULATION BETWEEN THE PARTIES WITH RESPECT TO SETTLEMENT OF CONTENTIONS Duke Power Company, gt. al.. (Applicants) and Charlotte-

_ Mecklenburg Environmental Coalition (CMEC), (the Parties) hereby agree and stipulate as follows:

1.

Operation of the Catawba Nuclear Station as presently i

designed will result in the release of small quantities of radioactivity into the Catawba River and into the air. Such releases will be well within the limits permitted by the regulations of the Nuclear Regulatory Commission. The dispute '

between CMEC and Applicant is about the health and genetic effects of these releases to the public. .

Applicants' position is that the preponderance of opinion in the scientific community supports their view that the health and genetic effects of these releases will be negligible. ,

CMEC, relying on the scientific work of a minority of the medical / scientific community (for example, Drs. Gofman, Tamplin, and Sternglass) believes that the proposed releases pose a health l hazard to the public.

r., o a-which were admitted as topics of litigation before the Atomic Safety and Licensing Board considering the Catawba operating license.'

2. The Parties agree that the issue in dispute concerns the radiological consequences from low level releases; neither Party believes now that the Catawba licensing pro-ceedings are a forum in which this dispute can be profitably ~

addressed.

3. Therefore, the Parties agree to settle their dispute as follows:
a. While confident of the correctness of its own position, Applicants respect CMEC's concerns. Therefore, Applicants
i. State their intent to keep the routine releases from the Catawba plant As Low As Reasonably Achievable (ALARA) consistent with the guidance of 10 CFR Part 50; ii. State their intent to keep abreast of technological advances in the field of radioactive waste treatment; and to be cognizant of and to consider, on a reasonable cost-benefit basis, the implementation of those technologies which may reduce the releases of routine radio-active wastes.
b. While maintaining its concerns about the health  !

and genetic effects of the routine releases from the Catawba Plant, CMEC withdraws its four contentions from the proceedings. '

(CMEC , however, wishes to maintain contact with the NRC Staff so as to be able to express concerns which relate to the 4

-4. The Parties agree that, on execution of this Stipulation, they will promptly submit it to the presiding Atomic Safety and Licensing Board for its approval.
