JOINT MOTION FOR APPROVAL OF STIPULATION )I Duke Power Company, et al. (Applicants) and Charlotte-Mecklenburg Environmental Coalition (CMEC), (the Parties) hereby jointly submit the attached " Stipulation Between The Parties With Respect to Settlement of Contentions" .(Stipulation) to the Board for its approval.

As the Stipulation reflects, Applicants and CMEC have reached agreement on the matters between them, as a result of which CMEC withdraws its four contentions from the proceeding. CMEC recognizes that acceptance of this withdrawal by the Board will result in its dismissal as a party co this proceeding. CMEC wishes to maintain contact with the NRC Staff to discuss, on an informal basis, matters relating to the subject of its withdrawn contentions.

Applicants have no objection to CMEC so doing and, based on conver-sations with the NRC Staff, it is the understanding of both Applicants and CMEC that the NRC Staff has no objection.

Therefore, the Parties request that this Board enter an Order which (1) Accepts the stipulation as written and dismisses the 8306290461 830623 PDR ADOCK 05000413 O PDR

four contentions of CMEC as issues in the proceeding; and i

(2) Dismisses CMEC as a party to this proceeding.
