1.0 INTRODUCTION

By [[letter::05000333/LER-1993-025-01, :on 931122,HPCI Sys Declared Inoperable Due to Turbine Stop Valve Failure to Close within Required Stroke Time Limit.Caused by Buildup of Hydraulic Fluid Residue in Solenoid Valves.Valves Cleaned & Rebuilt|letter dated December 22, 1993]], the Power Authority of the State of New York (the licensee) submitted a request for changes to the James A.

FitzPatrick Nuclear Power Plant Technical Specifications (TSs).

The requested changes would remove the reference to American Society for Testing and Materials (ASTM) Standard D 270-65 from Surveillance Requirement (SR) 4.12A.l.i.

ASTM D 270-65, which specifies procedures to draw a representative fuel oil sample, has been superseded and is no longer in effect.

The proposed amendment would allow the licensee to use ASTM D 4057-88 or subsequent industry standards for the sampling of diesel fire pump fuel oil.

2.0 LVALVATION SR 4.12A.I.i. provides acceptable limits for diesel fire pump fuel oil quality and currently requires that samples be obtained in accordance with ASTM D 270-65. ASTM D 270-65 has been superseded and is no longer'in effect.

The licensee has proposed that the reference to ASTM D 270-65 be removed from TS SR 4.12A l.i.

The proposed change would make SR 4.12A.I.i. consistent with fuel oil SR 4.9.C.l. for the emergency diesel generators.

The proposed change would also allow the licensee to adopt ASTM D 4057-88 or subsequent industry standards for the sampling of diesel fire pump fuel oil.

The licensee has proposed no changes to the acceptance criteria for fuel oil quality which are based on ASTM D 975-81.

i The NRC staff has determined that the proposed change to SR 4.12A.l.i. would delete reference to a superseded standard and provide the licensee with the necessary flexibility to adopt the current and subsequent industry standards for the sampling of diesel fire pump fuel oil.

The proposed change is, therefore, acceptable.

3.0 STATE CONSULTATION

1-In accordance with the Commission's regulations, the Nev York State official was notified of the proposed issuance of the amendment.

The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

The amendment changes a requirement with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 and changes surveillance requirements.

The NRC staff has determined that the amendment involves no significant increase in the amounts, and no i

significant change in the types, of any ef fluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure.

The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding (59 FR 4944).

Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.

The Commission has issued the enclosed Amendment No.214 to Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant.
