1.0 INTRODUCTION

By letter dated May 21, 1993, the Power Authority of the State of New York (the licensee) submitted a request for changes to the James A. FitzPatrick Nuclear Power Plant Technical Specifications (TS).

The requested changes would revise the TS Surveillance Requirements and associated Bases for the emergency diesel generator (EDG) fuel oil transfer system and the EDG air starting compressors to clarify that testing of these systems / components can be conducted either concurrent with or independent of the monthly EDG tests.

The changes would also clarify the Bases for EDG fuel quality testing and make an editorial change.

2.0 EVALVATION The licensee proposed changes to the TS to revise the Surveillance Requirements aad associated Bases for the emergency diesel generator (EDG) fuel oil transfer system and the EDG air starting compressors to clarify that testing of these systems and components can be conducted either concurrent with or independent of the monthly EDG tests.

The proposed changes also add the acceptance criteria for EDG fuel quality testing to Bases 4.9.C and make an editorial correction.

2.1 Diesel Fuel Oil Transfer Pump Testina Each diesel generator unit is provided with an independent fuel oil syctem consisting of a main fuel storage tank, a day tank, and pumps. Two ful'-

capacity motor-driven pumps are provided for filling the day tank from the storage tank.

TS Surveillance Requirement (SR) 4.9.C.2 required performance of the EDG fuel oil transfer system test in conjunction with the monthly EDG test.

The licensee proposed to revise SR 4.9.C.2 to allcw testing of the diesel fuel oil transfer system either concurrent with or independent of the monthly EDG testing. Concurrent or independent testing of the fuel oil transfer system provides greater flexibility in utilizing plant resources to meet surveillance requirements.

4 The changes to SR 4.9.C.2 involve no hardware modifications, alteration of system operations, or degradation of system performance.

Except for allowing independent testing, there are no changes to the procedures used for testing.

Independent system testing will not alter test effectiveness in determining system reliability nor will it alter testing methodology. There is no reduction in the ability of the systems fulfilling their respect'.vc functions in mitigating a design basis accident.

The change will not alter the level of confidence in system operability or capability.

There are no changes to emergency diesel generator fuel oil requirements.

The change does not alter the conclusions of existing accident analyses as documented in the Final Safety Analysis Report (FSAR) and NRC Safety Evaluation Report (SER).

Therefore, the NRC staff finds that the proposed change is acceptable.

2.2 Air Startina Comoressors Each EDG is provided with an independent air starting system.

Each EDG's air start system has sufficient capacity for at least 10 successful starts.

SR 4.9.8.2 states that once per month the diesel starting air compressors 4

shall be checked for proper operation and their ability to recharge air receivers.

As written, this specification allowed performance of air starting compressor testing at the same time or independent of the monthly EDG test.

This is inconsistent with Bases Section 4.9.B which indicates that the air starting compressor test is performed during the EDG test.

The licensee proposed to revise the Bases section to reflect both testing and surveillance requirement allowances to test air starting compressors concurrent with or independent of monthly EDG testing.

The proposed changes involve no hardware modifications, alteration of system operations, or degradation of system performance.

Except for allowing independent testing, there are no changes to the procedures used for testing.

Concurrent or independent testing of the air starting compressors provides greater flexibility in utilizing plant resources to meet surveillance requirements.

Independent system testing will not alter test effectiveness in determining air starting compressor reliability nor will it alter testing

methodology.

The change will not alter the level of confidence in air starting compressor operability or capability.

The change does not alter the conclusions of existing accident analyses as documented in the FSAR and NRC SER.

Therefore, the NRC staff finds the changes to be acceptable.

2.3 Fuel Oil Ouality Testina The licensee evaluated the effect of removing statements regarding micro-organism slime formation and water content from Bases 4.9.C.

Based on the evaluation, the licensee concluded that the microorganism check should be deleted because the microorganism check is performed as part of a quarterly check separate from the monthly EDG fuel oil quality test and is not a 4.9.C.1 Surveillance Requirement.

Bases 4.9.C also currently provides verification

. that the fuel quality is checked at specified intervals to determine water content; however, the water content limits are already contained in SR 4.9.C.l.

Therefore, the licensee concluded that references to micro-organism slime formation and water content in Bases 4.9.C are redundant and unnecessary.

The licensee also proposed to add acceptance criteria for EDG fuel quality testing to Bases 4.9.C since the current Bases does not identify the acceptance criteria for EDG fuel oil. The proposed change will revise the Bases Section by adding an operability statement for the fuel oil transfer system.

The licensee stated that adding the correct acceptance criteria for the EDG fuel oil will not alter the acceptability of the existing testing requirements or otherwise affect plant safety.

This change does not reduce test acceptance criteria or affect acceptance methodology.

The NRC staff finds that the changes will not affect current testing requirements for the EDG fuel oil.

Furthermore, deleting the acceptance criteria which are different than or repetitious to those in the stated surveillance requirement will not alter the acceptability of the existing i

testing requirements or otherwise affect plant safety.

This change does not reduce test acceptance criteria or affect acceptance test methodology.

There are no changes to the EDG fuel oil requirements and the changes do not alter the conclusions of existing accident analyses as documented in the FSAR and NRC SER.

Therefore, the NRC finds the changes to be acceptable.

2.4 Summary The NRC staff reviewed the information presented by the licensee and concludes that the proposed changes do not adversely affect plant safety and are acceptable.

3.0 STATE CONSVLTATION In accordance with the Commission's regulations, the New York State official was notified of the proposed issuance of the amendment.

The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

The amendment changes a requirement with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 and changes surveillance requirements.

The NRC staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding

. (58 FR 36443). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be. inimical to the common defense and security or to the health and safety of the public.

The Commission has issued the enclosed Amendment No. 205 to Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant.

The amendment consists of changes to the Technical Specifications (TSs) in response to your application transmitted by letter dated May 21, 1993.

The amendment revises the TS Surveillance Requirements and associated Bases for the emergency diesel. generator (EDG) fuel oil transfer system and the EDG 1

air starting compressors to clarify that testing of these systems / components can be conducted either concurrently or independently of the monthly EDG tests. The amendment also clarifies the Bases for EDG fuel quality testing.

A copy of the related Safety Evaluation is enclosed.

A Notice of Issuance will be included in the Commission's next regular biweekly Federal Reaister notice.
