Dear Mr. Denton:

Attached is a proposed change to the McGuire Nuclear Station Technical Specifica-tions regarding containment penetration type C leak rate tests. The proposed change is to allow a one month extension of the time interval between tests for one penetration in order that it coincide with a scheduled shutdown. This extended shutdown had originally been scheduled for October, 1982 to install a design modi-fication on the Model D Westinghouse steam generators. However, delays in delivery of the special tooling required for this modification have currently pushed the shutdown date to November 12, 1982. The Technical Specification exemption is re-quasted to extend through November 30, 1982 in anticipation of additional potential delays. No further extensions will be sought by Duke Power Company even should delays past November 30th be incurred since several additional penetration's sur-veillance testing intervals will have also expired.

Duke recognizes that in order to approve this Technical Specification change it is also necessary for the staff to grant an exemption to 10 CFR 50 Appendix J pursuant to 10 CFR 50.12a since the specification is based on this regulation. It is requested that this change receive imediate attention in view of the time period involved.

The proposed chauge has been reviewed and it has been determined that there are no adverse safety or environmental impacts associated with the change.

This change is considered to be a Class III license amendment pursuant to 10 CFR 170.22. Therefore, a check in the amount of $4,000 is enclosed.
